第一條 為了預(yù)防火災(zāi)和減少火災(zāi)危害，保護(hù)公民人身、公共財(cái)產(chǎn)和公民財(cái)產(chǎn)的安全，維護(hù)公共安全，保障社會(huì)主義現(xiàn)代化建設(shè)的順利進(jìn)行，制定本法。
Article 1 This law is formulated in the purpose of preventing fire and
reducing fire damage, safeguarding citizen's personal security, public property
and civil assets, upholding public security and ensuring the smooth construction
of the socialist modernization.
第二條 消防工作貫徹預(yù)防為主、消防結(jié)合的方針，堅(jiān)持專門機(jī)關(guān)與群眾相結(jié)合的原則，實(shí)行防火安全責(zé)任制。
Article 2 Fire control work shall follow the policy of devoting major efforts
into prevention and combining fire prevention with fire fighting, and shall
adhere to the principle of combining the efforts of both specialized
organizations and the masses and carry out responsibility system on fire
prevention and safety.
第三條 消防工作由國務(wù)院領(lǐng)導(dǎo)，由地方各級(jí)人民政府負(fù)責(zé)。
Article 3 The State Council shall led and the people's governments at all
levels be responsible for fire control work.
各級(jí)人民政府應(yīng)當(dāng)將消防工作納入國民經(jīng)濟(jì)和社會(huì)發(fā)展計(jì)劃，保障消防工作與經(jīng)濟(jì)建設(shè)和社會(huì)發(fā)展相適應(yīng)。
The people's government at all levels shall bring fire control work in line
with the national economy and social development plan, and ensure that fire
control work fit in with the economic construction and social development.
第四條 國務(wù)院公安部門對(duì)全國的消防工作實(shí)施監(jiān)督管理，
Article 4 The public security department of the State Council shall monitor
and administer the nationwide fire control work;
縣級(jí)以上地方各級(jí)人民政府公安機(jī)關(guān)對(duì)本行政區(qū)域內(nèi)的消防工作實(shí)施監(jiān)督管理，并由本級(jí)人民政府公安機(jī)關(guān)消防機(jī)構(gòu)負(fù)責(zé)實(shí)施。
the public security organs of local people's governments above county level
shall monitor and administer the fire control work within their administrative
region and the fire control institutions of public security organs of the
people's government at the same level shall be responsible for the
implementation.
軍事設(shè)施、礦井地下部分、核電廠的消防工作，由其主管單位監(jiān)督管理。
Fire control work for military facilities, underground parts of mines and
nuclear power plant shall be monitored and administered by their competent
units.
森林、草原的消防工作，法律、行政法規(guī)另有規(guī)定的，從其規(guī)定。
For fire control work on forest and grassland, in cases there are separate
regulations, the separate regulations shall be followed.
第五條 任何單位、個(gè)人都有維護(hù)消防安全、保護(hù)消防設(shè)施、預(yù)防火災(zāi)、報(bào)告火警的義務(wù)。
Article 5 Any unit and individual shall have the obligation of keeping fire
control safety, protecting fire control facilities, preventing fire disaster and
reporting fire alarm.
任何單位、成年公民都有參加有組織的滅火工作的義務(wù)。
Any unit and adult shall have the obligation to take part in organized fire
fighting work.
第六條 各級(jí)人民政府應(yīng)當(dāng)經(jīng)常進(jìn)行消防宣傳教育，提高公民的消防意識(shí)。
Article 6 The people's government at all levels shall carry out regular fire
control propaganda and education and strengthen citizens' awareness on fire
control.
教育、勞動(dòng)等行政主管部門應(yīng)當(dāng)將消防知識(shí)納入教學(xué)培訓(xùn)內(nèi)容。
Administrative department on education and labor shall put fire control
knowledge into teaching and training.
新聞、出版、廣播、電影、電視等有關(guān)主管部門，有進(jìn)行消防安全宣傳教育的義務(wù)。
Competent departments in journalism, publishing, broadcasting, movie and
television sector shall have the obligation to conduct propaganda and education
on fire control safety.
第七條 對(duì)在消防工作中有突出貢獻(xiàn)或者成績(jī)顯著的單位和個(gè)人，應(yīng)當(dāng)予以獎(jiǎng)勵(lì)。
Article 7 Units and individuals who make prominent contribution or
achievements in fire control work shall be awarded.
第二章 火災(zāi)預(yù)防
CHAPTER TWO FIRE PREVENTION
第八條 城市人民政府應(yīng)當(dāng)將包括消防安全布局、消防站、消防供水、消防通信、消防車通道、消防裝備等內(nèi)容的消防規(guī)劃納入城市總體規(guī)劃，并負(fù)責(zé)組織有關(guān)主管部門實(shí)施。
Article 8 Urban people's governments shall bring the fire control plan into
the overall urban planning, including fire control safety layout, fire control
station, fire control communication, fire truck passageway and fire control
equipment, etc, and take the charge of organizing relevant departments for its
implementation.
公共消防設(shè)施、消防裝務(wù)不足或者不適應(yīng)實(shí)際需要的，應(yīng)當(dāng)增建、改建、配置或者進(jìn)行技術(shù)改造。
In case public fire control facilities and equipage are insufficient or do not
fit in with actual demand, efforts should be made on expansion, rebuilding,
allocation and purchase or technical reform.
對(duì)消防工作，應(yīng)當(dāng)加強(qiáng)科學(xué)研究，推廣、使用先進(jìn)消防技術(shù)、消防設(shè)備。
Science research and promotion on fire control work should be reiterated and
advanced fire control technology and equipage should be adopted.
第九條 生產(chǎn)、儲(chǔ)存和裝卸易燃易爆危險(xiǎn)物品的工廠、倉庫和專用車站、碼頭，必須設(shè)置在城市的邊緣或者相對(duì)獨(dú)立的安全地帶。
Article 9 Existing factories and warehouses and specialized depots and wharves
for production, storage, loading and unloading of inflammable and explosive
dangerous goods, shall be established at urban border area or independent safety
zone.
易燃易爆氣體和液體的充裝站、供應(yīng)站、調(diào)壓站，應(yīng)當(dāng)設(shè)置在合理的位置，符合防火防爆要求。
Filling and loading stations, supply stations and pressure regulating stations
for inflammable and explosive gas and liquid shall be set up in an appropriate
location and shall conform to the requirements on prevention of fire and
explosion.
原有的生產(chǎn)、儲(chǔ)存和裝卸易燃易爆危險(xiǎn)物品的工廠、倉庫和專用車站、調(diào)壓站，不符合前款規(guī)定的，有關(guān)單位應(yīng)當(dāng)采取措施，限期加以解決。
For existing factories and warehouses and specialized depots and wharves for
production, storage, loading and unloading of inflammable and explosive
dangerous goods, and filling and loading stations, supply stations and pressure
regulating stations for inflammable and explosive gas and liquid, in case they
do not conform to the regulations of this article, relevant units shall adopt
measures to give a solution within a time limit.
第十條
按照國家工程建筑消防技術(shù)標(biāo)準(zhǔn)需要進(jìn)行消防設(shè)計(jì)的建筑工程、設(shè)計(jì)單位應(yīng)當(dāng)按照國家工程建筑消防技術(shù)標(biāo)準(zhǔn)進(jìn)行設(shè)計(jì)，建設(shè)單位應(yīng)當(dāng)建筑單位的消防設(shè)計(jì)圖紙及有關(guān)資料報(bào)送公安消防機(jī)關(guān)審核；
Article 10 For construction project conducting fire control design in
accordance with requirements of the State Technical Standards on Fire Control
for Engineering Construction, the design unit shall conduct the design in
accordance with requirements of the State Technical Standards on Fire Control
for Engineering Construction; the construction unit shall submit the drawings of
fire control design for the construction project and relevant materials to
relevant public security fire control institution for review and approval;
未經(jīng)審核或者經(jīng)審核不合格的，建設(shè)行政主管部門不得發(fā)給施工許可證，建設(shè)單位不得施工。
for project not going through review and approval formalities or considered
unqualified after the review and examination, the competent construction
administrative department shall not issue the license for construction and the
construction unit shall not carry out the construction.
經(jīng)公安消防機(jī)構(gòu)審核的建筑工程消防設(shè)施需要變更的，應(yīng)當(dāng)報(bào)經(jīng)原審核的公安消防機(jī)構(gòu)核準(zhǔn)；未經(jīng)核準(zhǔn)的，任何單位、個(gè)人不得變更。
For fire control design for construction project approved by relevant public
security fire control institution, in case the design needs changes, it shall be
submitted to the previous public security fire control institution granting the
approval for examination and approval; without approval, no unit or individual
shall be allowed to make the changes.
按照國家工程建筑消防技術(shù)標(biāo)準(zhǔn)進(jìn)行消防設(shè)計(jì)的建筑工程竣工時(shí)，必須經(jīng)公安消防機(jī)構(gòu)進(jìn)行消防驗(yàn)收；未經(jīng)驗(yàn)收或者經(jīng)驗(yàn)收不合格的，不得投入使用。
Upon the completion of a construction project containing a fire control design
conducted in accordance with requirements of the State Technical Standards on
Fire Control for Engineering Construction, the project must go through
acceptance checked on fire control by relevant public security fire control
institutions; project without going through the acceptance check or considered
unqualified after the acceptance check shall not be put into use.
第十一條 建筑構(gòu)件和建筑材料的防火性能必須符合國家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)。
Article 11 The fire proof performance of constructional elements and
construction materials must conform to the state standards or industrial
standards.
公共場(chǎng)所室內(nèi)裝修、裝飾根據(jù)國家工程建筑消防技術(shù)標(biāo)準(zhǔn)的規(guī)定，應(yīng)當(dāng)使用不燃、難燃材料的，必須選用依照產(chǎn)品質(zhì)量法的規(guī)定確定的檢驗(yàn)機(jī)構(gòu)檢驗(yàn)合格的材料。
The indoor fittings and decoration of public places using inflammable and
flame retardant materials in accordance with requirements of the State Technical
Standards on Fire Control for Engineering Construction, shall choose materials
passing qualification check by inspection institution designated in accordance
with regulations of the Product Quality Law.
第十二條 歌舞廳、影劇院、賓館、飯店、商場(chǎng)、集貿(mào)市場(chǎng)等公眾聚集的場(chǎng)所，在使用或者開業(yè)前，應(yīng)當(dāng)向當(dāng)?shù)毓蚕罊C(jī)構(gòu)申報(bào)，經(jīng)消防安全檢查合格后，方可使用或者開業(yè)。
Article 12 Song and dance hall, cinema, hotel, restaurant, commercial center
and market fair where the public gather, before putting into use or starting
business, shall be reported to local public security fire control institutions
and can only be put into use or start business after passing the acceptance
check on fire control safety.
第十三條
舉辦大型集會(huì)、焰火晚會(huì)、燈會(huì)等群眾性活動(dòng)，具有火災(zāi)危險(xiǎn)的，主辦單位應(yīng)當(dāng)制定滅火和應(yīng)急疏散預(yù)案，落實(shí)消防安全措施，并向公安消防機(jī)構(gòu)申報(bào)，經(jīng)公安消防機(jī)構(gòu)對(duì)活動(dòng)現(xiàn)場(chǎng)進(jìn)行消防安全檢查合格后，方可舉辦。
Article 13 For mass activities with fire danger, such as large gatherings,
fireworks evening party and lantern party, the host unit shall formulate
preproposal on fire fighting and emergency evacuation and put into effect
relevant fire control security measures, and report to public security fire
control institutions which will conduct fire control security check. The
activities can only be held when qualification check is granted.
第十四條 機(jī)關(guān)、團(tuán)體、企業(yè)、事業(yè)單位應(yīng)當(dāng)履行下列消防安全職責(zé)：
Article 14 State organs, organizations, enterprises and institutions shall
perform the following duties on fire control security:
?。ㄒ唬┲贫ㄏ腊踩贫?、消防安全操作規(guī)程；
(I) Formulate fire control safety system and operation rules on fire control
safety;
（二）實(shí)行防火安全責(zé)任制，確定本單位和各所屬部門、崗位的消防安全責(zé)任人；
(II) Exercise fire prevention safety responsibility system, appoint
person-in-charge for fire control safety of the unit and various departments and
posts under the unit;
?。ㄈ┽槍?duì)本單位的特點(diǎn)對(duì)職工進(jìn)行消防宣傳教育；
(III) Conduct fire control propaganda and education on employees in light of
the characteristics of the unit,
?。ㄋ模┙M織防火檢查，及時(shí)消除火災(zāi)隱患；
(IV) Organize fire prevention inspection and remove hidden danger in time;
?。ㄎ澹┌凑諊矣嘘P(guān)規(guī)定配置消防設(shè)施和器材，設(shè)置消防安全標(biāo)志，并定期組織檢驗(yàn)、維修，確保消防設(shè)施和器材完好、有效；
(V) Allocate and purchase fire control facilities and devices, set up fire
control safety marks in accordance with relevant state regulations, and organize
regular inspection and maintenance to ensure a perfect and effective condition
of fire control facilities and device;
（六）保障疏散通道、安全出口暢通，并設(shè)置符合國家規(guī)定的消防安全疏散標(biāo)志；
(VI) Ensure that evacuation passageway and safety exit are unblocked and set
up evacuation marks on fire control safety conforming to the state regulations.
居民住宅區(qū)的管理單位，應(yīng)當(dāng)依照前款有關(guān)規(guī)定，履行消防安全職責(zé)，做好住宅區(qū)的消防安全工作。
The administrative unit of residential areas shall perform duties and
responsibilities on fire control safety in accordance with regulations of this
article and do a good job on fire control safety in the residential areas.
第十五條 在設(shè)有車間或者倉庫的建筑物內(nèi)，不得設(shè)置員工集體宿舍。
Article 15 Rooms within the same building of workshop or warehouse shall not
be used as dormitory.
在設(shè)有車間或者倉庫的建筑物內(nèi)，已經(jīng)設(shè)置員工集體宿舍的，應(yīng)當(dāng)限期加以解決。
In case rooms in a building with workshop or warehouse have already been used
as dormitory, the problem shall be solved within a time limit.
對(duì)于暫時(shí)確有困難的，應(yīng)當(dāng)采取必要的消防安全措施，經(jīng)公安消防機(jī)構(gòu)批準(zhǔn)后，可以繼續(xù)使用。
Those who indeed have difficulties for the time being, shall take necessary
fire control safety measures and can only continue to use the dormitory after
acquiring approval from public security fire control institutions.
第十六條
縣級(jí)以上地方人民政府公安機(jī)關(guān)消防機(jī)構(gòu)應(yīng)當(dāng)將發(fā)生火災(zāi)可能性較大以及一旦發(fā)生火災(zāi)可能造成人身重大傷亡或者財(cái)產(chǎn)重大損失的單位，確定為本行政區(qū)域內(nèi)的消防重點(diǎn)單位，報(bào)本級(jí)人民政府備案。
Article 16 For units with higher risk of fire disaster and units that may
cause major casualties and deaths or heavy loss of assets in case of fire
disaster, the public security fire control institutions of local people's
governments above county level shall select these units as key units on fire
control safety of their administrative region and file with the people's
government of the same level for reference.
消防安全重點(diǎn)單位除應(yīng)當(dāng)履行本法第十四條規(guī)定的職責(zé)外，還應(yīng)當(dāng)履行下列消防安全職責(zé)：
Key units on fire control safety shall, in addition to performing the duties
and responsibilities as stipulated in Article 14 of this law, perform the
following duties and responsibilities on fire control safety:
?。ㄒ唬┙⒎阑饳n案，確定消防安全重點(diǎn)部位，設(shè)置防火標(biāo)志，實(shí)行嚴(yán)格管理；
(I) Set up file system on fire prevention, locate critical parts for fire
control safety, set up fire prevention marks and exercise strict administration;
（二）實(shí)行每日防火巡查，并建立巡查記錄；
(II) Exercise daily fire prevention patrol and set up patrol record;
?。ㄈ?duì)職工進(jìn)行消防安全培訓(xùn)；
(III) Conduct fire control safety training on employees;
?。ㄋ模┲贫缁鸷蛻?yīng)急疏散預(yù)案，定期組織消防演練。
(IV) Formulate pre-proposal on fire fighting and emergency evacuation and
organize regular fire drill.
第十七條 生產(chǎn)、儲(chǔ)存、運(yùn)輸、銷售或者使用、銷毀易燃易爆危險(xiǎn)物品的單位、個(gè)人，必須執(zhí)行國家有關(guān)消防安全的規(guī)定。
Article 17 Any unit and individual engaged in production, storage,
transportation, sales or use and destroy of inflammable and explosive dangerous
goods, must execute relevant state regulations on fire control safety.
生產(chǎn)易燃易爆危險(xiǎn)物品的單位，對(duì)產(chǎn)品應(yīng)當(dāng)附有燃點(diǎn)、閃點(diǎn)、爆炸極限等數(shù)據(jù)的說明書，并且注明防火防爆注意事項(xiàng)。
Units producing inflammable and explosive dangerous goods shall attach
instruction book with datas such as the ignition point, flash point and
explosion limit of the product, and give points of attention for fire and
explosion prevention.
對(duì)獨(dú)立包裝的易燃易爆危險(xiǎn)物品應(yīng)當(dāng)貼附危險(xiǎn)品標(biāo)簽。
Inflammable and explosive dangerous goods with independent packing shall be
attached with a tag of dangerous goods.
進(jìn)入生產(chǎn)、儲(chǔ)存易燃易爆危險(xiǎn)物品的場(chǎng)所，必須執(zhí)行國家有關(guān)消防安全的規(guī)定。
Those who enter places where inflammable and explosive dangerous goods are
produced and stored, must execute the state regulations on fire control safety.
禁止攜帶火種進(jìn)入生產(chǎn)、儲(chǔ)存易燃易爆危險(xiǎn)物品的場(chǎng)所。
It is prohibited to carry kindling into places where inflammable and explosive
dangerous goods are produced and stored.
禁止非法攜帶易燃易爆危險(xiǎn)物品進(jìn)入公共場(chǎng)所或者乘坐公共交通工具。
It is prohibited to illegally carry inflammable and explosive dangerous goods
into public places or on public transportation means.
儲(chǔ)存可燃物資倉庫的管理，必須執(zhí)行國家有關(guān)消防安全的規(guī)定。
The management of warehouses storing inflammable goods must be in execution of
relevant state regulations on fire control safety.
第十八條 禁止在具有火災(zāi)、爆炸危險(xiǎn)的場(chǎng)所使用明火；因特殊情況需要使用明火作業(yè)的，應(yīng)當(dāng)按照規(guī)定事先辦理審批手續(xù)。
Article 18 It is prohibited to use naked light in places with fire and
explosion danger; in case naked light operation is required for special reasons,
examination and approval formalities shall be handled in accordance with
relevant regulations.
作業(yè)人員應(yīng)當(dāng)遵守消防安全規(guī)定，并采取相應(yīng)的消防安全措施。
Operators shall follow the regulations on fire control safety and adopt
corresponding measures on fire control safety.
進(jìn)行電焊、氣焊等具有火災(zāi)危險(xiǎn)的作業(yè)的人員和自動(dòng)消防系統(tǒng)的操作人員，必須持證上崗，并嚴(yán)格遵守消防安全操作規(guī)程。
Operators conducting operation with fire danger like electrical welding and
gas welding or operators for automatic fire control system, must hold relevant
certificates and strictly observe operation rules on fire control safety.
第十九條 消防產(chǎn)品的質(zhì)量必須符合國家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)。
Article 19 The quality of fire control products must conform to the state
standards or industrial standards.
禁止生產(chǎn)、銷售或者使用未經(jīng)依照產(chǎn)品質(zhì)量法的規(guī)定確定的檢驗(yàn)機(jī)構(gòu)檢驗(yàn)合格的消防產(chǎn)品。
It is prohibited to produce, sell or use fire control products without passing
qualification check by the inspection organ designated in accordance with
regulations of the Product Quality Law.
禁止使用不符合國家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)的配件或者滅火劑維修消防設(shè)施和器材。
It is prohibited to use complementary fire control parts, extinguishant,
maintenance and fire control facilities and devices not conforming to the state
standards or industrial standards.
公安消防機(jī)構(gòu)及其工作人員不得利用職務(wù)為用戶指定消防產(chǎn)品的銷售單位和品牌。
Public security fire control institutions and their staff shall not specify
sales units and brands of fire control products in the capacity of their
functions.
第二十條 電器產(chǎn)品、燃?xì)庥镁叩馁|(zhì)量必須符合國家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)。
Article 20 The quality of electrical products and gas utensils must conform to
the state standards or industrial standard.
電器產(chǎn)品、燃?xì)庥镁叩陌惭b、使用和線路、管路的設(shè)計(jì)、敷設(shè)，必須符合國家有關(guān)消防安全技術(shù)規(guī)定。
The installation, use and design and laying of circuit and pipes must conform
to relevant technical regulations on fire control.
第二十一條 任何單位、個(gè)人不得損壞或者擅自挪用、拆除、停用消防設(shè)施、器材，不得埋壓、圈占消火栓，不得占用消防間距，不得堵塞消防通道。
Article 21 Any unit or individual shall not damage or arbitrarily use,
dismantle and stop using fire control facilities and devices, and shall not bury
and occupy hydrant, occupy fire prevention space and block fire control
passageway.
公用和城建等單位在修建道路以及停電、停水、截?cái)嗤ㄐ啪€路時(shí)有可能影響消防隊(duì)滅火救援的，必須事先通知當(dāng)?shù)毓蚕罊C(jī)構(gòu)。
Public utility units or urban construction units, when building road and
cutting off power, water supply and communication lines that may affect fire
brigade in fire fighting and rescue work, must inform local public security fire
control institutions in advance.
第二十二條
在農(nóng)業(yè)收獲季節(jié)、森森和草原防火期間、重大節(jié)假日期間以及火災(zāi)多發(fā)季節(jié)，地方各級(jí)人民政符應(yīng)當(dāng)組織開展有針對(duì)性的消防宣傳教育，采取防火措施，進(jìn)行消防安全檢查。
Article 22 During farm products harvest seasons and fire prevention period of
forest and grassland, major holidays and frequent fire disaster seasons, local
people's government at all levels shall organize and carry out fire control
propaganda and education according to the specific situations, adopt fire
prevention measures and conduct fire control safety inspection.
第二十三條 村民委員會(huì)、居民委員會(huì)應(yīng)當(dāng)開展群眾性的消防工作，組織制定防火安全公約，進(jìn)行消防安全檢查。
Article 23 Villagers committee and neighborhood committee shall organize the
masses to carry out fire control work, formulate fire prevention safety
convention and conduct fire control safety inspection.
鄉(xiāng)鎮(zhèn)人民政府、城市街道辦事處應(yīng)予以指導(dǎo)和監(jiān)督。
The township people's governments and urban neighborhood offices shall give
guidance and supervision.
第二十四條 公安消防機(jī)構(gòu)應(yīng)當(dāng)對(duì)機(jī)關(guān)、團(tuán)體、企業(yè)、事業(yè)單位遵守消防法律、法規(guī)的情況依法進(jìn)行監(jiān)督檢查。
Article 24 Public security fire control institutions shall monitor and conduct
inspection on state organs, organizations, enterprises and institutions in terms
of their observance of fire control laws and regulations.
對(duì)消防安全重點(diǎn)單位應(yīng)當(dāng)定期監(jiān)督檢查。
For key units for fire control safety, regular monitoring and inspection shall
be conducted.
公安消防機(jī)構(gòu)的工作人員在進(jìn)行監(jiān)督檢查時(shí)，應(yīng)當(dāng)出示證件。
Working staff of public security fire control institutions, when conducting
supervision and inspection, shall produce certificates.
公安消防機(jī)構(gòu)進(jìn)行消防審核、驗(yàn)收等監(jiān)督檢查不得收取費(fèi)用。
Public security fire control institutions, when conducting fire control
examination and approval and acceptance check, shall not collect fees.
第二十五條 公安消防機(jī)構(gòu)發(fā)現(xiàn)火災(zāi)隱患，應(yīng)當(dāng)及時(shí)通知有關(guān)單位或者個(gè)人采取措施，限時(shí)消除隱患。
Article 25 Public security fire control institutions, when finding out hidden
fire danger, shall inform relevant units or individuals in time to take measures
and order to remove the hidden danger within a time limit.
第三章 消防組織
CHAPTER THREE FIRE CONTROL ORGANIZATIONS
第二十六條 各級(jí)人民政府應(yīng)當(dāng)根據(jù)經(jīng)濟(jì)和社會(huì)發(fā)展的需要，建立多種形式的消防組織，加強(qiáng)消防組織建設(shè)，增強(qiáng)撲救火災(zāi)的能力。
Article 26 The people's government at all levels shall, in accordance with the
requirement of economic and social development, set up fire control
organizations in multi forms, strengthen construction of fire control
organizations and the abilities on fire fighting.
第二十七條 城市人民政府應(yīng)當(dāng)按照國家規(guī)定的消防站建設(shè)標(biāo)準(zhǔn)建立公安消防隊(duì)、專職消防隊(duì)、承擔(dān)火災(zāi)撲救工作。
Article 27 Urban people's governments shall, in accordance with the standards
on fire control station construction, set up public security fire brigade, full
time fire brigade to undertake fire fighting and rescue work.
鎮(zhèn)人民政府可以根據(jù)當(dāng)?shù)亟?jīng)濟(jì)發(fā)展和消防工作的需要，建立專職消防隊(duì)、義務(wù)消防隊(duì)，承擔(dān)火災(zāi)撲救工作。
Township people's governments may, in accordance with the requirements of
economic development and fire control work, set up full time and voluntary fire
brigades to undertake fire fighting and rescue work.
公安消防隊(duì)除保證完成本法規(guī)定的火災(zāi)撲救工作外，還應(yīng)當(dāng)參加其他災(zāi)害或者事故的搶險(xiǎn)救援工作。
Public security fire brigades, except guaranteeing to carry out fire fighting
and rescue work as stipulated in this law, should also do rescue and relief work
of other disasters or accidents.
第二十八條 下列單位應(yīng)當(dāng)建立專職消防隊(duì)，承擔(dān)本單位的火災(zāi)撲救工作：
Article 28 The following units shall set up full time fire brigades to
undertake fire fighting and rescue work.
?。ㄒ唬┖穗姀S、大型發(fā)電廠、民用機(jī)場(chǎng)、大型港口；
(I) Nuclear power plant, large power plant, civil airports and large wharves;
?。ǘ┥a(chǎn)、儲(chǔ)存易燃易爆危險(xiǎn)物品的大型企業(yè)；
(II) Large enterprises producing and storing inflammable and explosive
dangerous goods;
（三）儲(chǔ)備可燃的重要物資 的重要倉庫、基地；
(III) Large warehouses and bases storing inflammable important goods;
?。ㄋ模┑谝豁?xiàng)、第二項(xiàng)、第三項(xiàng)規(guī)定以外的火災(zāi)危險(xiǎn)性較大、距離當(dāng)?shù)毓蚕狸?duì)較遠(yuǎn)的其他大型企業(yè)；
(IV) Other large enterprises other than those listed in Item (I) (II) (III),
but with high risk of fire disaster and are far from local public security fire
brigades.
第二十九條 專職消防隊(duì)的建立，應(yīng)當(dāng)府合國家有關(guān)規(guī)定，并報(bào)省級(jí)人民政符公安機(jī)關(guān)消防機(jī)構(gòu)驗(yàn)收。
Article 29 The establishment of full time fire brigade shall conform to
relevant regulations of the state and be submitted to fire control institutions
of public security organs of the people's government at provincial level.
第三十條 機(jī)關(guān)、團(tuán)體、企業(yè)、事業(yè)單位以及鄉(xiāng)、村可以根據(jù)需要，建立由職工或者村民組成的義務(wù)消防隊(duì)
Article 30 State organs, organizations, enterprises and institutions as well
as towns and villages may set up obligatory fire brigade consisting of working
staff or villager based on need.
第三十一條 公安消防機(jī)構(gòu)應(yīng)當(dāng)對(duì)專職消防隊(duì)、義務(wù)消防隊(duì)進(jìn)行業(yè)務(wù)指導(dǎo)，并有權(quán)指揮調(diào)動(dòng)專職消防隊(duì)參加火災(zāi)撲救工作。
Article 31 Public security fire control institutions shall give business
guidance to full time and obligatory fire brigades, and shall have the right to
direct and muster full time fire brigade for fire fighting and rescue work.
第四章 滅火救援
CHAPTER FOUR FIRE FIGHTING AND RESCUE
第三十二條 任何人發(fā)現(xiàn)火災(zāi)時(shí)，都應(yīng)當(dāng)立即報(bào)警。
Article 32 Any one who discover a fire shall immediately report to the police.
任何單位、個(gè)人都應(yīng)當(dāng)無償為報(bào)警提供便利，不得阻攔報(bào)警。嚴(yán)禁謊報(bào)火警。
Any unit and individual shall provide convenience for fire alarm reporting
gratis and shall not obstruct the reporting. It is strictly prohibited to make
false reporting of fire.
公共場(chǎng)所發(fā)生火災(zāi)時(shí)，該公共場(chǎng)所的現(xiàn)場(chǎng)工作人員的組織、引導(dǎo)在場(chǎng)群眾疏散的義務(wù)。
In case a fire occurs in a public place, the on site working staff of the
public place shall have the obligation to organize and guide the evacuation of
on-site masses.
發(fā)生火災(zāi)的單位必須立即組織力量撲救火災(zāi)。鄰近單位應(yīng)當(dāng)給予支援。
Units suffering fire disaster shall immediately organize fire fighting and
rescue work. Neighboring units shall provide support.
消防隊(duì)接到火警后，必須立即趕赴火場(chǎng)，救 助遇險(xiǎn)人員，排除險(xiǎn)情，撲滅火災(zāi)。
Fire brigades, upon receiving fire reporting, must rush to fire site
immediately to rescue people under mishap, eliminate dangerous case and
extinguish fire.
第三十三條 公安消防機(jī)構(gòu)在統(tǒng)一組織和指揮火災(zāi)的現(xiàn)場(chǎng)撲救時(shí)，火場(chǎng)總指揮有權(quán)根據(jù)撲救火災(zāi)的需要，決定下列事項(xiàng)：
Article 33 Public security fire control institutions, when making unified
organization and direction of on site fire fighting and rescue, the chief
commander shall have the right to determine the following matters in accordance
with the requirements of fire fighting and rescue work:
（一）使用各種水源；
(I) Use of various water sources;
（二）截?cái)嚯娏?、可燃?xì)怏w和液體的輸送，限制用火用電；
(II) Cut off transmission of power, inflammable gas and liquid, and restrict
the use of fire and power;
?。ㄈ﹦澏ň鋮^(qū)，實(shí)行局部交通管制；
(III) Delimit warning zone and exercise local transportation control;
（四）利用臨近建筑物和有關(guān)設(shè)施；
(IV) Make use of neighboring constructions and related facilities;
?。ㄎ澹榉乐够馂?zāi)蔓延，拆除或者破損毗鄰火場(chǎng)的建筑物、構(gòu)筑物；
(V) Dismantle or damage neighboring constructions and structures of fire site
so as to prevent fire spreading;
（六）調(diào)動(dòng)供水、供電、醫(yī)療救護(hù)、交通運(yùn)輸?shù)扔嘘P(guān)單位協(xié)助滅火救助。
(VI) Muster relevant units of water and power supply, medical and rescue and
transportation to assist the fire fighting and rescue work.
撲救特大火災(zāi)時(shí)，有關(guān)地方人民政府應(yīng)當(dāng)組織有關(guān)人員、調(diào)集所需物資支援滅火。
For ultra large fire disaster, relevant local people's government shall
organize relevant personnel and assemble necessary goods to support the fire
fighting.
第三十四條 公安消防隊(duì)參加火災(zāi)以外的其他災(zāi)害或者事故的搶險(xiǎn)救援工作， 在有關(guān)地方人民政府的統(tǒng)一指揮下實(shí)施。
Article 34 Public security fire control institutions, when conducting relief
and rescue work of other disasters or accidents other than fire disaster, shall
carry out the task under unified direction of relevant local people's
government.
第三十五條
消防車、消防艇前往執(zhí)行火災(zāi)撲救任務(wù)或者執(zhí)行其他災(zāi)害、事故的搶險(xiǎn)救援任務(wù)時(shí)，不受行駛速度、行駛路線、行駛方向和指揮信號(hào)的限制，其他車輛、船舶以及行人必須讓行，不得穿插、超越。
Article 35 Fire trucks and fire boats, when rushing for fire fighting and
rescue work or relief and rescue task for other disaster and accidents, shall
not be restricted by its driving speed, driving route, driving direction and
traffic signals; other vehicles, ships and pedestrians must make way and shall
not conduct overtaking.
交通管理指揮人員應(yīng)當(dāng)保證消防車、消防艇迅速通行。
Traffic commander shall guarantee the fast and smooth passing of fire trucks
and fire boats.
第三十六條 消防車、消防艇以及消防器材、裝備和設(shè)施，不得用于與消防和搶險(xiǎn)救援工作無關(guān)的事項(xiàng)。
Article 36 Fire truck, fire boats and fire control devices, equipage and
facilities shall not be used for purposes other than fire fighting and rescue
work.
第三十七條 公安消防隊(duì)撲救火災(zāi)，不得向發(fā)生火災(zāi)的單位、個(gè)人收取任何費(fèi)用。
Article 37 Fire brigades shall not charge any fee for fire fighting and rescue
work from units and individuals suffering fire disaster.
對(duì)參加撲救外單位火災(zāi)的專職消防隊(duì)、義務(wù)消防隊(duì)所損耗的燃料、滅火劑和器材、裝備等，依照規(guī)定予以補(bǔ)償。
Full time fire brigade and obligatory fire brigade shall be compensated for
fuel, extinguishant and device and equipage used in taking part of fire fighting
and rescue for other units.
第三十八條 對(duì)因參加撲救火災(zāi)受傷、致殘或者死亡的人員，按照國家有關(guān)規(guī)定給予醫(yī)療、撫恤。
Article 38 Personnel suffering injury, cripple and death as a result of taking
part of fire fighting and rescue work, shall be given medical treatment and
compensation.
第三十九條 火災(zāi)撲滅后，公安消防機(jī)構(gòu)有權(quán)根據(jù)需要封閉火災(zāi)現(xiàn)場(chǎng)，負(fù)責(zé)調(diào)查、認(rèn)定火災(zāi)原因，核定火災(zāi)損失，查明火災(zāi)事故責(zé)任。
Article 39 After a fire is extinguished, public security fire control
institutions shall, based on need, have the right to seal up fire site, be
responsible for investigation, identify fire cause, check and ratify fire losses
and find out responsibilities of fire disasters.
對(duì)于特大火災(zāi)事故，國務(wù)院或者省級(jí)人民政府認(rèn)為必要時(shí)，可以組織調(diào) 查。
For ultra large fire disasters, in case the State Council or the people's
government at provincial level consider it necessary, an investigation can be
organized.
火災(zāi)撲滅后，起火單位應(yīng)當(dāng)按照公安消防機(jī)構(gòu)的要求保護(hù)現(xiàn)場(chǎng)，接受事故調(diào)查，如實(shí)提供火災(zāi)事實(shí)的情況。
After a fire is extinguished, fire breaking units shall protect fire site in
accordance with requirements of public security fire control institutions,
accept investigation on the accident and provide accurate facts on the fire
disaster.
第五章 法律責(zé)任
CHAPTER FIVE LEGAL RESPONSIBILITIES
第四十條 違反本法的規(guī)定，有下列行為之一的，責(zé)令限期改正；逾期不改正的，責(zé)令停止施工、停止使用或者停產(chǎn)停業(yè)，可以并外罰款：
Article 40 Any one who violates the rules of this law and has one of the
following conducts, shall be ordered to make corrections within a time limit;
those who do not make the corrections after the time limit, shall be ordered to
stop construction, stop use of things concerned or stop production or business,
and may be punished with penalty simultaneously:
?。ㄒ唬┙ㄖこ痰南涝O(shè)計(jì)未經(jīng)公安消防機(jī)構(gòu)審核或者審核不合格，擅自施工的；
(I) Those who start construction when the fire control design of the
construction projects have not be reviewed and approved or be considered
disqualified after the review and examination by relevant public security fire
control institutions.
?。ǘ┮婪☉?yīng)當(dāng)進(jìn)行消防設(shè)計(jì)的建筑工程竣工時(shí)未經(jīng)消防驗(yàn)收或者經(jīng)驗(yàn)收不合格，擅自使用的；
(II) Those who make arbitrary use of a completed construction project which
should conduct fire control design in accordance with law but has not passed or
fail to pass the fire control acceptance check;
（三）公眾聚集的場(chǎng)所未經(jīng)消防安全檢查或者經(jīng)檢查不合格，擅自使用或者開業(yè)的。
(III) Those who arbitrarily make use of or start business in places where the
public gather without going through fire control safety check or fail to pass
the qualification check;
單位有前款行為的，依照前款的規(guī)定處罰，并對(duì)其直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員處警告或者罰款。
(IV) Units with conduct of this article shall be punished in accordance with
rules of this article and the person in charge with direct responsibility or
other personnel with direct responsibility shall be given warning or penalty.
第四十一條 違反本法的規(guī)定,擅自舉辦大型集會(huì)、焰火晚會(huì)、燈火等群眾性活動(dòng)，具有火災(zāi)危險(xiǎn)的，公安消防機(jī)構(gòu)應(yīng)當(dāng)責(zé)令當(dāng)場(chǎng)改正；
Article 41 Those who, in violation of this law, arbitrarily hold mass
activities like large gatherings, fireworks evening party, lantern party with
risk of fire disaster, shall be ordered to make corrections by public security
fire control institutions;
當(dāng)場(chǎng)不能改正的，應(yīng)當(dāng)責(zé)令停止舉辦，可以并處罰款。
those who can not make the corrections, shall be ordered to suspend the
activities and may be imposed with penalty.
單位有前款行為的，依照前款的規(guī)定處罰，并對(duì)其直接的主管人員和其他直接責(zé)任人員處警告或者罰款。
(V) Units with the conduct of this article shall be punished in accordance
with the rules of this article, and the person in charge with direct
responsibility or other personnel with direct responsibility shall be given
disciplinary warning or penalty.
第四十二條
違反本法的規(guī)定，擅自降低消防技術(shù)標(biāo)準(zhǔn)施工、使用防火性能不符合國家標(biāo)準(zhǔn)或者行業(yè)標(biāo)準(zhǔn)的建筑構(gòu)件和建筑材料或者不合格的裝修、裝飾材料施工的，責(zé)令限期改正；
Article 42 Those who, in violation of this law, arbitrarily lower technical
standards on fire control in construction, us construction parts and materials
not conforming the state standards or industrial standards or disqualified
fitting and decoration materials during construction, shall be ordered to make
corrections within a time limit;
逾期不改正的，責(zé)令停止施工，可以并處罰款。
those who do not make the corrections within the time limit, shall be ordered
to stop construction, and can be imposed with penalty simultaneously.
單位有前款行為的，依照前款的規(guī)定處罰，并對(duì)其直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員處警告或者罰款。
Units with the conduct of this article, shall be punished in accordance with
rules of this article; and the person in charge with direct responsibility or
other personnel with direct responsibility shall be given disciplinary warning
or penalty.
第四十三條 機(jī)關(guān)、團(tuán)體、企業(yè)、事業(yè)單位違反本法的規(guī)定，未履行消防安全職責(zé)的，責(zé)令限期改正；
Article 43 State organs, organizations, enterprises and institutions who
violates rules of this law and do not perform responsibilities or fire control
safety, shall be ordered to make corrections within a time limit;
逾期不改正的，對(duì)其直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員依法給予行政處分或者處警告。
for units who do not make the corrections within the time limit, the person in
charge with direct responsibility or other personnel with direct responsibility
shall be given administrative sanction or disciplinary warning.
營業(yè)性場(chǎng)所有下列行為之一的，責(zé)令限期改正；逾期不改正的，責(zé)令停產(chǎn)停業(yè)，可以并處罰款，并對(duì)其直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員處罰款：
Operational places with one of the following conducts shall be ordered to make
corrections within a time limit; those who do not make the corrections within
the time limit, shall be ordered to stop production and business, and can be
imposed with penalty simultaneously; the person in charge with direct
responsibility or other personnel with direct responsibility shall be imposed
with penalty:
?。ㄒ唬?duì)火災(zāi)隱患不及時(shí)消除的；
(I) Those who do not remove fire danger in time;
?。ǘ┎话凑諊矣嘘P(guān)規(guī)定，配置消防設(shè)施和器材的；
(II) Those who do not, in accordance with relevant regulations of the state,
allocate and purchase fire control facilities and devices;
（三）不能保障疏散通道、安全出口暢通的。
(III) Those who do not guarantee the evacuation passageway and safety exist
unblocked.
在設(shè)有車間或者倉庫的建筑物內(nèi)設(shè)置員工集體宿舍的，依照第二款的規(guī)定處罰。
Those who use rooms in a building with workshop or warehouse as dormitory
shall be punished in accordance with rules of Article 2.
第四十四條
違反本法的規(guī)定，生產(chǎn)、銷售未經(jīng)依照產(chǎn)品質(zhì)量法的規(guī)定確定檢驗(yàn)機(jī)構(gòu)檢驗(yàn)合格的消防產(chǎn)品的，責(zé)令停止違法行為，沒收產(chǎn)品和違法所得，依照產(chǎn)品質(zhì)量法的規(guī)定從重處罰。
Article 44 Those who, in violation the rules of this law, produce and sell
fire control products that have not passed qualification check by inspection
institutions designated in accordance with rules of the Product Quality Law,
shall be ordered to stop illegal action, and be confiscated with product and
illegal income, and be strictly punished in accordance with the rules of the
Product Quality Law.
維修、檢測(cè)消防設(shè)施、器材的單位，違反消防安全技術(shù)規(guī)定，進(jìn)行維修、檢測(cè)的，責(zé)令限期改正，可以并處罰款，并對(duì)其直接負(fù)責(zé)的主管人員和其他責(zé)任人員處警告或者罰款。
Those units engaged in maintenance and check and test of fire control
facilities and devices, carry out maintenance and check and test in violation of
rules on fire control technology, shall be ordered to make corrections within a
time limit and can be imposed with penalty simultaneously; and the person in
charge with direct responsibility or other personnel with direct responsibility
shall be given disciplinary: warning or penalty.
第四十五條 電器產(chǎn)品、燃?xì)庥镁叩陌惭b或者線路、管路的敷設(shè)不符合消防安全技術(shù)規(guī)定的，責(zé)令限期改正；逾期不改正的，責(zé)令停止使用。
Article 45 In case the installation of electrical appliances and gas utensils
or the laying of circuits and pipelines do not conform to the rules of fire
control technology, the person in charge shall be ordered to make corrections
within a time limit; those who do not make the corrections within the time
limit, shall be ordered to stop the use.
第四十六條 違反本法的規(guī)定，生產(chǎn)、儲(chǔ)存、運(yùn)輸、銷售或者使用銷毀易燃易爆危險(xiǎn)物品的，責(zé)令停止違法行為，可以處警告、罰款或者十五日以下拘留。
Article 46 Those who, in violation the rules of this law, produce, store,
transport, sell or use, destroy inflammable and explosive dangerous goods, shall
be ordered to stop illegal activities, and can be given disciplinary warning,
penalty or disciplinary warning or penalty.
單位有前款行為的，責(zé)令停止違法行為，可以處警告或者罰款，并對(duì)其直接負(fù)責(zé)的主管人員和其他直接責(zé)任人員依照前款的規(guī)定處罰。
Those units with the conduct of this article, shall be ordered to stop illegal
activities, and can be given disciplinary warning or penalty, and the person in
charge with direct responsibility or other personnel with direct responsibility
shall be punished in accordance with rules of this article.
第四十七條 違反本法的規(guī)定，有下列行為之一的，處警告、罰款或者十日以下拘留：
Article 47 Those who, in violation the rules of this law, have one of the
following conducts, shall be given disciplinary warning or penalty, or detention
less than 15 days:
?。ㄒ唬┻`反消防安全規(guī)定進(jìn)入生產(chǎn)、儲(chǔ)存易燃易爆危險(xiǎn)物品場(chǎng)所的；
(I) Those who, in violation the rules of this law, enter places where
inflammable and explosive dangerous goods are produced and stored;
?。ǘ┻`法使用明火作業(yè)或者在具有火災(zāi)、爆炸危險(xiǎn)的場(chǎng)所違反禁令，吸煙、使用明火的；
(II) Those who, in violation law, use naked light in operation or who, in
violation of prohibition, smoke, use naked light in places with fire and
explosion danger.
?。ㄈ┳钄r報(bào)火警或者謊報(bào)火警的；
(III) Those who obstruct fire alarm reporting or make false report on fire
disaster;
?。ㄋ模┕室庾璧K消防車、消防艇趕赴火災(zāi)現(xiàn)場(chǎng)或者擾亂火災(zāi)現(xiàn)場(chǎng)秩序的；
(IV) Those who deliberately obstruct fire truck and fire boasts from rushing
to fire site or who disturb the order of fire site;
?。ㄎ澹┚懿粓?zhí)行火場(chǎng)指揮員指揮，影響滅火救災(zāi)的；
(V) Those who refuse to obey the command of fire site commander and influence
fire fighting and rescue work;
?。┻^失引起火災(zāi)，尚未造成重大損失的。
(VI) Those whose blunder causes fire but has not resulted in heavy losses.
第四十八條 違反本法的規(guī)定，有下列行為之一的，處警告或者罰款：
Article 48 Those who violates the rules of this law and have one of the
following conducts, shall be given disciplinary warning or penalty:
（一）指使或者強(qiáng)令他人違反消防安全規(guī)定，冒險(xiǎn)作業(yè)，尚未造成嚴(yán)重后果的；
(I) Those who instigate or force others to conduct operation at risk in
violation the rules on fire control safety, but have not cause serious results;
?。ǘ┞駢?、圈占消火栓或者占用消防間距、堵塞消防通道的，或者損壞和擅自挪用、拆除、停用消防設(shè)施、器材的；
(II) Those who bury, occupy fire hydrant or occupy fire prevention space,
block fire control passageway, or damage and arbitrarily use, dismantle and stop
use fire control facilities and devices;
（三）有重大火災(zāi)隱患，經(jīng)公安消防機(jī)構(gòu)通知逾期不改正的。
(III) Those who do not remove serious fire danger after being informed by
public security fire control institutions;
單位有前款行為的，依照前款的規(guī)定處罰，并對(duì)其直接負(fù)責(zé)的主管人員和其他直接現(xiàn)任人員處警告或者罰款。
Units with the conduct of this article shall be punished in accordance with
rules of this article; and the person in charge with direct responsibility or
other personnel with direct responsibility shall be disciplinary warning or
penalty.
有第一款第二項(xiàng)所列行為的，還應(yīng)當(dāng)責(zé)令其限期恢復(fù)原狀或者賠償損失；對(duì)逾期不恢復(fù)原狀的，應(yīng)當(dāng)強(qiáng)制拆除或者清除、所需費(fèi)用由違法行為人承擔(dān)。
Those who have the conduct listed in item 2 of Clause 1, shall be further
ordered to make restoration or compensate the losses within a time limit; for
those who do not make the restoration after the time limit, a forcible execution
will be carried out on the dismantle or cleaning up at the expense of the
person(s) with illegal conduct.
第四十九條 公共場(chǎng)所發(fā)生火災(zāi)時(shí)，該公共場(chǎng)所的現(xiàn)場(chǎng)工作人員不履行組織、引導(dǎo)在場(chǎng)群眾疏散的義務(wù)，造成人身傷亡，尚不構(gòu)成犯罪的，處十五日以下拘留。
Article 49 On site working staff of public places, in case of a fire, do not
perform the obligation of organizing and guiding the evacuation of the on site
masses, and cause casualty and death, but do not constitute a criminal charge,
shall be punished with detention less than 15 days.
第五十條 火災(zāi)撲滅后，為隱瞞、掩飾起火原因、推卸責(zé)任，故意破壞現(xiàn)場(chǎng)或者偽造現(xiàn)場(chǎng)，尚不構(gòu)成犯罪的，處警告、罰款或者十五日以下拘留。
Article 50 For those who, after a fire is extinguished, deliberately destroy
the fire site or make a simulated scene in the purpose of concealing and
covering up fire causes and shirking their responsibility, but do not constitute
a criminal charge, shall be given disciplinary warning or penalty and the person
in charge with direct responsibility or other personnel with direct
responsibility shall be punished in accordance with this article.
第五十一條 對(duì)違反本法規(guī)定的處罰，由公安消防機(jī)構(gòu)裁決。
Article 51 The punishment on conducts violating the rules of this law shall be
decided by public security fire control institutions;
對(duì)給予拘留的處罰，由公安機(jī)關(guān)依照治安管理處罰條例的規(guī)定裁決。
punishment of detention shall be decided by public security organs in
accordance with rules of penal clauses on public order administration.
第五十二條 公安消防機(jī)構(gòu)的工作人員在消防工作中濫用職權(quán)、玩忽職守、徇私舞弊，有下列行為之一，給國家和人民利益造成損失，尚不構(gòu)成犯罪的，依法給予行政處分：
Article 52 The working staff of public security fire control institutions, in
case of abusing their authority, ignoring their duty and playing favoritism and
committing irregularities, and having one of the following conducts, causing
loss to the benefit of the state and people, but having not constituted a
criminal charge, shall be given administrative sanction in accordance with law:
?。ㄒ唬?duì)不符合國家建筑工程消防技術(shù)標(biāo)準(zhǔn)的消防設(shè)計(jì)、建筑工程通過審核、驗(yàn)收的；
(I) Those who pass the examination and approval and acceptance check to fire
control design and construction projects that do not conform to the state
technical standards on fire control for construction projects;
?。ǘ?duì)應(yīng)當(dāng)依法審核、驗(yàn)收的消防設(shè)計(jì)、建筑工程，故意拖延，不予審核、驗(yàn)收的；
(II) Those who deliberately delay in giving and do not give examination and
approval and acceptance check to fire control design and construction projects
that shall be given examination and approval and acceptance check in accordance
with law.
?。ㄈ┌l(fā)現(xiàn)火災(zāi)隱患不及時(shí)通知有關(guān)單位或者個(gè)人改正的；
(III) Those who do not inform relevant units or individual to make corrections
when finding hidden danger of fire.
（四）利用職務(wù)為用戶指定消防產(chǎn)品的銷售單位、品牌或者指定建筑消防設(shè)施施工單位的；
(IV) Those who, in the capacity of their function, specify sales units or
brands of fire control products or specify construction units of fire control
facilities.
?。ㄎ澹┢渌麨E用職權(quán)、玩忽職守、徇私舞弊的行為。
(V) Other conducts involving abusing authority, dereliction of duty and
playing favoritism and committing irregularities.
第五十三條 有違反本法行為，構(gòu)成犯罪的，依法追究刑事責(zé)任。
Article 53 Those who violate this law and commit a criminal offence will be
punished as a crime.
第五十四條
本法自1998年9月1日起施行。1984年5月11日第六屆全國人民代表大會(huì)常務(wù)委員會(huì)第五次會(huì)議批準(zhǔn)、1984年5月13日國務(wù)院公布的《中華人民共和國消防條例》同時(shí)作廢。
Article 54 This law shall come into force as of September 1, 1998. Meanwhile,
the "Regulations on Fire Control of the People's Republic of China" approved by
the fifth meeting of the Standing Committee of the 6th National People's
Congress on May 11, 1984 and promulgated by the State Council on May 13, 1984
shall be annulled simultaneously.
