第一章總則
Chapter I General Provisions
第一條為了加強(qiáng)對(duì)動(dòng)物防疫工作的管理，預(yù)防、控制和撲滅動(dòng)物疫病，促進(jìn)養(yǎng)殖業(yè)發(fā)展，保護(hù)人體健康，制定本法。
Article 1 This Law is enacted for the purpose of intensifying the
administration of animal epidemic prevention, preventing, bringing under control
and exterminating animal epidemics, promoting the development of livestock, fish
breeding and poultry raising and protecting human health.
第二條本法適用于在中華人民共和國(guó)領(lǐng)域內(nèi)的動(dòng)物防疫活動(dòng)。
Article 2 This Law is applicable to animal epidemic prevention activities
within the territory of the People’s Republic of China.
進(jìn)出境動(dòng)物、動(dòng)物產(chǎn)品的檢疫，適用《中華人民共和國(guó)進(jìn)出境動(dòng)植物檢疫法》。
For quarantine of entry and exit animals or animal products, the Law of the
People’s Republic of China on the Entry and Exit Animal and Plant Quarantine
shall apply.
第三條本法所稱動(dòng)物，是指家畜家禽和人工飼養(yǎng)、合法捕獲的其他動(dòng)物。
Article 3 "Animal" referred to in this Law means livestock, poultry and other
animals raised by man or caught legally.
本法所稱動(dòng)物產(chǎn)品，是指動(dòng)物的生皮、原毛、精液、胚胎、種蛋以及未經(jīng)加工的胴體、脂、臟器、血液、絨、骨、角、頭、蹄等。
"Animal product" referred to in this Law means animals’ raw hides, hairs,
semen, embryos and breeder eggs as well as non-processed products such as
trunks, grease, viscera, blood, down, bones, horns, heads and hoofs.
本法所稱動(dòng)物疫病，是指動(dòng)物傳染病、寄生蟲病。
"Animal epidemic" referred to in this Law means animal infectious diseases and
parasitic diseases.
本法所稱動(dòng)物防疫，包括動(dòng)物疫病的預(yù)防、控制、撲滅和動(dòng)物、動(dòng)物產(chǎn)品的檢疫。
"Animal epidemic prevention" referred to in this Law includes prevention,
control and extermination of animal epidemics as well as quarantine of animals
and animal products.
第四條動(dòng)物屠宰，依照本法對(duì)其胴體、頭、蹄和內(nèi)臟實(shí)施檢疫、監(jiān)督。經(jīng)檢疫合格作為食品的，其衛(wèi)生檢驗(yàn)、監(jiān)督，依照《中華人民共和國(guó)食品衛(wèi)生法》的規(guī)定辦理。
Article 4 Quarantine inspection and supervision shall be conducted pursuant to
this Law over trunks, heads and viscera of slaughtered animals. Those up to
standards for foods after quarantine inspection shall be subjected to hygienic
inspection and supervision in accordance with the provisions of the Food Hygiene
Law of the People’s Republic of China.
第五條國(guó)家對(duì)動(dòng)物疫病實(shí)行預(yù)防為主的方針。
Article 5 The state institutes a policy of focusing on prevention of animal
epidemics.
第六條國(guó)務(wù)院畜牧獸醫(yī)行政管理部門主管全國(guó)的動(dòng)物防疫工作。
Article 6 The animal husbandry and veterinary administrative department under
the State Council shall be in charge of animal epidemic prevention throughout
the country.
縣級(jí)以上地方人民政府畜牧獸醫(yī)行政管理部門主管本行政區(qū)域內(nèi)的動(dòng)物防疫工作。
The animal husbandry and veterinary administrative departments under local
people’s governments at or above the county level shall be in charge of animal
epidemic prevention within their respective administrative areas.
縣級(jí)以上人民政府所屬的動(dòng)物防疫監(jiān)督機(jī)構(gòu)實(shí)施動(dòng)物防疫和動(dòng)物防疫監(jiān)督。
The supervising agencies for animal epidemic prevention under people’s
governments at or above the county level shall execute animal epidemic
prevention and supervision on animal epidemic prevention.
軍隊(duì)的動(dòng)物防疫監(jiān)督機(jī)構(gòu)負(fù)責(zé)軍隊(duì)現(xiàn)役動(dòng)物及軍隊(duì)飼養(yǎng)自用動(dòng)物的防疫工作。
The supervising agencies for animal epidemic prevention in the armed forces
shall be responsible for epidemic prevention for active-duty animals in the
armed forces and animals raised by the armed forces for their own use.
第七條各級(jí)人民政府應(yīng)當(dāng)加強(qiáng)對(duì)動(dòng)物防疫工作的領(lǐng)導(dǎo)。
Article 7 People’s governments at all levels shall strengthen the leadership
over animal epidemic prevention.
第八條國(guó)家鼓勵(lì)、支持動(dòng)物防疫的科學(xué)研究，推廣先進(jìn)的科學(xué)研究成果，普及動(dòng)物防疫的科學(xué)知識(shí)，提高動(dòng)物防疫水平。
Article 8 The state encourages and supports scientific research on animal
epidemic prevention, spreads advanced achievements of scientific research,
popularizes scientific knowledge of animal epidemic prevention, and improves the
level of animal epidemic prevention.
第九條在動(dòng)物防疫工作、動(dòng)物防疫科學(xué)研究中做出成績(jī)和貢獻(xiàn)的單位和個(gè)人，由人民政府或者畜牧獸醫(yī)行政管理部門給予獎(jiǎng)勵(lì)。
Article 9 Any unit or individual that has made achievements or contributions
in animal epidemic prevention or scientific research on animal epidemic
prevention shall be rewarded by the people’s government or the animal husbandry
and veterinary administrative department.
第二章動(dòng)物疫病的預(yù)防
Chapter II Prevention of Animal Epidemics
第十條根據(jù)動(dòng)物疫病對(duì)養(yǎng)殖業(yè)生產(chǎn)和人體健康的危害程度，本法規(guī)定管理的動(dòng)物疫病分為下列三類：
Article 10 In the light of seriousness of damage caused by animal epidemics to
the breeding production and human health, animal epidemics under the control by
this Law are composed of three classes:
?。ㄒ唬┮活愐卟?，是指對(duì)人畜危害嚴(yán)重、需要采取緊急、嚴(yán)厲的強(qiáng)制預(yù)防、控制、撲滅措施的；
(1) Epidemics of Class I refer to those which cause serious damage to humans
and animals and need to take urgent, rigorous measures to compulsorily prevent,
bring under control or exterminate them.
?。ǘ┒愐卟。侵缚稍斐芍卮蠼?jīng)濟(jì)損失、需要采取嚴(yán)格控制、撲滅措施，防止擴(kuò)散的；
(2) Epidemics of Class II refer to those which can cause great economic losses
and need to take strict measures to bring under control or exterminate them and
avoid their spread.
（三）三類疫病，是指常見多發(fā)、可能造成重大經(jīng)濟(jì)損失、需要控制和凈化的。
(3) Epidemics of Class III refer to those which are so common and so
frequently occur that great economic losses may be caused and control and
purifying measures are required.
前款三類疫病的具體病種名錄由國(guó)務(wù)院畜牧獸醫(yī)行政管理部門規(guī)定并公布。
A detailed catalogue of epidemics of the three classes mentioned in the
preceding paragraph shall be fixed and published by the animal husbandry and
veterinary administrative department under the State Council.
第十一條國(guó)務(wù)院畜牧獸醫(yī)行政管理部門應(yīng)當(dāng)制定國(guó)家動(dòng)物疫病預(yù)防規(guī)劃。
Article 11 The animal husbandry and veterinary administrative department under
the State Council shall formulate the national plan for animal epidemic
prevention.
國(guó)務(wù)院畜牧獸醫(yī)行政管理部門根據(jù)國(guó)內(nèi)外動(dòng)物疫情和保護(hù)養(yǎng)殖業(yè)生產(chǎn)及人體健康的需要，及時(shí)規(guī)定并公布動(dòng)物疫病預(yù)防辦法。
The animal husbandry and veterinary administrative department under the State
Council shall, in the light of animal epidemic situation abroad and at home and
in accordance with the requirements for protection of the breeding production
and human health, formulate and publish in time measures for animal epidemic
prevention.
國(guó)家對(duì)嚴(yán)重危害養(yǎng)殖業(yè)生產(chǎn)和人體健康的動(dòng)物疫病實(shí)行計(jì)劃免疫制度，實(shí)施強(qiáng)制免疫。
The state practices a system of immunization planning for execution of
compulsory immunization against animal epidemics which cause serious damage to
the breeding production and human health.
實(shí)施強(qiáng)制免疫的動(dòng)物疫病病種名錄由國(guó)務(wù)院畜牧獸醫(yī)行政管理部門規(guī)定并公布。
A catalogue of animal epidemics subjected to compulsory immunization shall be
formulated and published by the animal husbandry and veterinary administrative
department under the State Council.
實(shí)施強(qiáng)制免疫以外的動(dòng)物疫病預(yù)防，由縣級(jí)以上地方人民政府畜牧獸醫(yī)行政管理部門制定計(jì)劃，報(bào)同級(jí)人民政府批準(zhǔn)后實(shí)施。
For other animal epidemics than those subjected to compulsory immunization,
the animal husbandry and veterinary administrative departments under local
people’s governments at or above the county level shall formulate prevention
plans and report them to the people’s governments at the same level for approval
and implementation.
第十二條國(guó)家應(yīng)當(dāng)采取措施預(yù)防和撲滅嚴(yán)重危害養(yǎng)殖業(yè)生產(chǎn)和人體健康的動(dòng)物疫病。
Article 12 The state should take measures to prevent and exterminate animal
epidemics which cause serious damage to the breeding production and human
health.
預(yù)防和撲滅動(dòng)物疫病所需的藥品、生物制品和有關(guān)物資，應(yīng)當(dāng)有適量的儲(chǔ)備，并納入國(guó)民經(jīng)濟(jì)和社會(huì)發(fā)展計(jì)劃。
Medicine, biological products or other relevant materials needed in prevention
and extermination of animal epidemics shall be reserved in a proper quantity and
shall be included in the plan for national economy and social development.
第十三條動(dòng)物防疫監(jiān)督機(jī)構(gòu)應(yīng)當(dāng)加強(qiáng)對(duì)動(dòng)物疫病預(yù)防的宣傳教育和技術(shù)指導(dǎo)、技術(shù)培訓(xùn)、咨詢服務(wù)，并組織實(shí)施動(dòng)物疫病免疫計(jì)劃。
Article 13 The supervising agencies for animal epidemic prevention shall
strengthen animal epidemic prevention by conducting popularization and
education, technical advice, technical training and consultancy services and
shall organize the implementation of plans for immunization against animal
epidemics.
鄉(xiāng)、民族鄉(xiāng)、鎮(zhèn)的動(dòng)物防疫組織應(yīng)當(dāng)在動(dòng)物防疫監(jiān)督機(jī)構(gòu)的指導(dǎo)下，組織做好動(dòng)物疫病預(yù)防工作。
Animal epidemic prevention organs in townships, nationality townships and
towns shall, under the guidance of the supervising agencies for animal epidemic
prevention, organize the prevention of animal epidemics.
第十四條飼養(yǎng)、經(jīng)營(yíng)動(dòng)物和生產(chǎn)、經(jīng)營(yíng)動(dòng)物產(chǎn)品的單位和個(gè)人，應(yīng)當(dāng)依照本法和國(guó)家有關(guān)規(guī)定做好動(dòng)物疫病的計(jì)劃免疫、預(yù)防工作，并接受動(dòng)物防疫監(jiān)督機(jī)構(gòu)的監(jiān)測(cè)、監(jiān)督。
Article 14 Units and individuals that engage in raising or marketing of
animals, or production or marketing of animal products shall, pursuant to this
Law and the relevant state provisions, complete planned immunization against and
prevention of animal epidemics, and shall accept the monitoring and supervision
from the supervising agencies for animal epidemic prevention.
第十五條動(dòng)物飼養(yǎng)場(chǎng)應(yīng)當(dāng)及時(shí)撲滅動(dòng)物疫病。種畜、種禽應(yīng)當(dāng)達(dá)到國(guó)家規(guī)定的健康合格標(biāo)準(zhǔn)。
Article 15 Any animal farm should exterminate animal epidemics in time. Stud
stock and breeding poultry shall be kept healthy up to the standards set by the
state.
第十六條動(dòng)物、動(dòng)物產(chǎn)品的運(yùn)載工具、墊料、包裝物應(yīng)當(dāng)符合國(guó)務(wù)院畜牧獸醫(yī)行政管理部門規(guī)定的動(dòng)物防疫條件。
Article 16 Means of transport, padding materials and packing materials for
animals or animal products shall meet the requirements for animal epidemic
prevention set by the animal husbandry and veterinary administrative department
under the State Council.
染疫動(dòng)物及其排泄物、染疫動(dòng)物的產(chǎn)品、病死或者死因不明的動(dòng)物尸體，必須按照國(guó)務(wù)院畜牧獸醫(yī)行政管理部門的有關(guān)規(guī)定處理，不得隨意處置。
Animals infected with epidemic diseases and their excrement, products made
from animals infected with epidemic diseases, and carcasses of animals which
died of illness or died due to an unidentified cause must be disposed of
according to the relevant provisions of the animal husbandry and veterinary
administrative department under the State Council and shall not be dealt with at
will.
第十七條保存、使用、運(yùn)輸動(dòng)物源性致病微生物的，應(yīng)當(dāng)遵守國(guó)家規(guī)定的管理制度和操作規(guī)程。
Article 17 The storage, use and transportation of animal-borne pathogenic
microorganisms shall conform to the management systems and operational rules set
by the state.
因科研、教學(xué)、防疫等特殊需要，運(yùn)輸動(dòng)物病料的，應(yīng)當(dāng)按照國(guó)家有關(guān)規(guī)定運(yùn)輸。
The transportation of animal epidemic materials for special need in scientific
research, teaching and epidemic prevention shall conform to the relevant state
provisions.
從事動(dòng)物疫病科學(xué)研究的單位應(yīng)當(dāng)按照國(guó)家有關(guān)規(guī)定，對(duì)實(shí)驗(yàn)動(dòng)物嚴(yán)格管理，防止動(dòng)物疫病傳播。
Any unit engaging in scientific research on animal epidemics shall, according
to the relevant state provisions, conduct strict management of experimental
animals in order to prevent the spread of animal epidemics.
第十八條禁止經(jīng)營(yíng)下列動(dòng)物、動(dòng)物產(chǎn)品：
Article 18 Marketing of any animal or animal product in the following
categories shall be prohibited:
?。ㄒ唬┓怄i疫區(qū)內(nèi)與所發(fā)生動(dòng)物疫病有關(guān)的；
(1) Those related to an animal epidemic disease occurring in a cordoned-off
epidemic area;
（二）疫區(qū)內(nèi)易感染的；
(2) Those susceptible to an epidemic disease in an epidemic area;
（三）依法應(yīng)當(dāng)檢疫而未經(jīng)檢疫或者檢疫不合格的；
(3) Those subjected to quarantine inspection according to law but failing to
undergo or pass quarantine inspection;
?。ㄋ模┤疽叩模?br>
(4) Those infected with an epidemic disease;
?。ㄎ澹┎∷阑蛘咚酪虿幻鞯?；
(5) Those which died of illness or died due to an unidentified cause; or
?。┢渌环蠂?guó)家有關(guān)動(dòng)物防疫規(guī)定的。
(6) Those not listed above but failing to conform to the state provisions
regarding animal epidemic prevention.
第三章動(dòng)物疫病的控制和撲滅
Chapter III Control and Extermination of Animal Epidemics
第十九條國(guó)務(wù)院畜牧獸醫(yī)行政管理部門統(tǒng)一管理并公布全國(guó)動(dòng)物疫情，也可以根據(jù)需要授權(quán)省、自治區(qū)、直轄市人民政府畜牧獸醫(yī)行政管理部門公布本行政區(qū)域內(nèi)的動(dòng)物疫情。
Article 19 The animal husbandry and veterinary administrative department under
the State Council shall exercise unified control over and publish animal
epidemic information nationwide, or may, when necessary, authorize the animal
husbandry and veterinary administrative departments under people’s governments
of provinces, autonomous regions and municipalities directly under the Central
Government to publish animal epidemic information within their own
administrative regions.
第二十條任何單位或者個(gè)人發(fā)現(xiàn)患有疫病或者疑似疫病的動(dòng)物，都應(yīng)當(dāng)及時(shí)向當(dāng)?shù)貏?dòng)物防疫監(jiān)督機(jī)構(gòu)報(bào)告。
Article 20 Any unit or individual that finds an animal(s) having an epidemic
disease or suspect of having an epidemic disease shall in time report to the
local supervising agency for animal epidemic prevention.
動(dòng)物防疫監(jiān)督機(jī)構(gòu)應(yīng)當(dāng)迅速采取措施，并按照國(guó)家有關(guān)規(guī)定上報(bào)。
The latter shall promptly take measures and report the case to the higher
authority according to the relevant state provisions.
任何單位和個(gè)人不得瞞報(bào)、謊報(bào)、阻礙他人報(bào)告動(dòng)物疫情。
No unit or individual may conceal, falsely report or hinder another person
from reporting animal epidemic information.
第二十一條發(fā)生一類動(dòng)物疫病時(shí)，當(dāng)?shù)乜h級(jí)以上地方人民政府畜牧獸醫(yī)行政管理部門應(yīng)當(dāng)立即派人到現(xiàn)場(chǎng)，劃定疫點(diǎn)、疫區(qū)、受威脅區(qū)，采集病料，調(diào)查疫源，及時(shí)報(bào)請(qǐng)同級(jí)人民政府決定對(duì)疫區(qū)實(shí)行封鎖，將疫情等情況逐級(jí)上報(bào)國(guó)務(wù)院畜牧獸醫(yī)行政管理部門。
Article 21 In the case of an animal epidemic of Class I, the animal husbandry
and veterinary administrative department under the local people’s government at
or above the county level shall dispatch its personnel to the scene forthwith to
delimit the epidemic point, the epidemic area and the threatened area, collect
epidemic materials, investigate into the epidemic source, report in time to the
people’s government at the same level for a decision of cordoning off the
epidemic area, and report the epidemic situation and the related information
level by level to the animal husbandry and veterinary administrative department
under the State Council.
縣級(jí)以上地方人民政府應(yīng)當(dāng)立即組織有關(guān)部門和單位采取隔離、撲殺、銷毀、消毒、緊急免疫接種等強(qiáng)制性控制、撲滅措施，迅速撲滅疫病，并通報(bào)毗鄰地區(qū)。
The local people’s government at or above the county level shall organize
departments and units concerned without delay to take compulsory measures for
control and extermination of the animal epidemic such as isolation, massacre,
destruction, disinfection and emergency immunization vaccination to exterminate
the epidemic disease promptly, and shall inform the neighboring areas of the
case.
在封鎖期間，禁止染疫和疑似染疫的動(dòng)物、動(dòng)物產(chǎn)品流出疫區(qū)，禁止非疫區(qū)的動(dòng)物進(jìn)入疫區(qū)，并根據(jù)撲滅動(dòng)物疫病的需要對(duì)出入封鎖區(qū)的人員、運(yùn)輸工具及有關(guān)物品采取消毒和其他限制性措施。
During the sanitary cordon, animals or animal products having the epidemic
disease or suspect of having the epidemic disease are prohibited from moving out
of the epidemic area, and animals coming from outside the epidemic area shall be
prohibited from entering the epidemic area. As required for the extermination of
the animal epidemic, persons, means of transport and relevant articles which
leave or enter the cordoned-off area shall be disinfected and imposed upon other
restrictions.
疫區(qū)范圍涉及兩個(gè)以上行政區(qū)域的，由有關(guān)行政區(qū)域共同的上一級(jí)人民政府決定對(duì)疫區(qū)實(shí)行封鎖，或者由各有關(guān)行政區(qū)域的上一級(jí)人民政府共同決定對(duì)疫區(qū)實(shí)行封鎖。
Where the epidemic area involves two or more administrative regions, the
decision on the cordon of the epidemic area shall be made by the common people’s
government at the next higher level than the concerned administrative regions,
or jointly by the people’s governments at the next higher level than the
concerned administrative regions.
第二十二條發(fā)生二類動(dòng)物疫病時(shí)，當(dāng)?shù)乜h級(jí)以上地方人民政府畜牧獸醫(yī)行政管理部門應(yīng)當(dāng)劃定疫點(diǎn)、疫區(qū)、受威脅區(qū)。
Article 22 In the case of an animal epidemic of Class II, the animal husbandry
and veterinary administrative department under the local people’s government at
or above the county level shall delimit the epidemic point, the epidemic area
and the threatened area.
縣級(jí)以上地方人民政府應(yīng)當(dāng)根據(jù)需要組織有關(guān)部門和單位采取隔離、撲殺、銷毀、消毒、緊急免疫接種、限制易感染的動(dòng)物、動(dòng)物產(chǎn)品及有關(guān)物品出入等控制、撲滅措施。
The local people’s government at or above the county level shall, when
necessary, organize departments and units concerned to take control and
extermination measures such as isolation, massacre, destruction, disinfection,
emergency immunization vaccination and imposition of restrictions upon entering
and leaving of the epidemic area by animals, animal products and relevant
articles that are susceptible to the epidemic disease.
第二十三條疫點(diǎn)、疫區(qū)、受威脅區(qū)和疫區(qū)封鎖的解除，由原決定機(jī)關(guān)宣布。
Article 23 The disestablishment of the epidemic point, the epidemic area and
the threatened area and the lifting of the cordon of the epidemic area shall be
announced by the organ that made the original decision.
第二十四條發(fā)生三類動(dòng)物疫病時(shí)，縣級(jí)、鄉(xiāng)級(jí)人民政府應(yīng)當(dāng)按照動(dòng)物疫病預(yù)防計(jì)劃和國(guó)務(wù)院畜牧獸醫(yī)行政管理部門的有關(guān)規(guī)定，組織防治和凈化。
Article 24 In the case of an animal epidemic of Class III, the people’s
government at the county or township level shall organize the prevention and
purification of the epidemic according to the plans for animal epidemic
prevention and the provisions of the animal husbandry and veterinary
administrative department under the State Council.
第二十五條二類、三類動(dòng)物疫病呈暴發(fā)性流行時(shí)，依照本法第二十一條的規(guī)定辦理。
Article 25 The provisions of Article 21 in this Law shall apply if an animal
epidemic of Class II or Class III spreads violently.
第二十六條為控制、撲滅重大動(dòng)物疫情，動(dòng)物防疫監(jiān)督機(jī)構(gòu)可以派人參加當(dāng)?shù)匾婪ㄔO(shè)立的現(xiàn)有檢查站執(zhí)行監(jiān)督檢查任務(wù)；
Article 26 For the purpose of control or extermination of major animal
epidemic situations, the supervising agencies for animal epidemic prevention may
dispatch their personnel to the inspecting stations having been set up according
to law by the locality to undertake supervision and inspection.
必要時(shí)，經(jīng)省、自治區(qū)、直轄市人民政府批準(zhǔn)，可以設(shè)立臨時(shí)性的動(dòng)物防疫監(jiān)督檢查站，執(zhí)行監(jiān)督檢查任務(wù)。
When necessary, provisional supervising and inspecting stations for animal
epidemic prevention may be set up subject to the approval of the people’s
government of the province, autonomous region and municipality directly under
the Central Government in order to perform supervision and inspection.
第二十七條發(fā)生人畜共患疫病時(shí)，有關(guān)畜牧獸醫(yī)行政管理部門應(yīng)當(dāng)與衛(wèi)生行政部門及有關(guān)單位互相通報(bào)疫情。畜牧獸醫(yī)行政管理部門、衛(wèi)生行政部門及有關(guān)單位應(yīng)當(dāng)及時(shí)采取控制、撲滅措施。
Article 27 In the case of an epidemic disease contracted commonly by both
human beings and livestock, the animal husbandry and veterinary administrative
department, the public health administrative department and other units
concerned shall exchange information on the epidemic situation and shall take
control and extermination measures in time.
第二十八條疫區(qū)內(nèi)有關(guān)單位和個(gè)人，應(yīng)當(dāng)遵守縣級(jí)以上人民政府及其畜牧獸醫(yī)行政管理部門依法作出的有關(guān)控制、撲滅動(dòng)物疫病的規(guī)定。
Article 28 Any unit or individual within an epidemic area shall observe the
stipulations of the people’s government at or above the county level and its
animal husbandry and veterinary administrative department for the control and
extermination of the animal epidemic.
第二十九條發(fā)生動(dòng)物疫情時(shí)，航空、鐵路、公路、水路等運(yùn)輸部門應(yīng)當(dāng)優(yōu)先運(yùn)送控制、撲滅疫情的人員和有關(guān)物資，電信部門應(yīng)當(dāng)及時(shí)傳遞動(dòng)物疫情報(bào)告。
Article 29 In the case of an animal epidemic, transportation departments such
as civil aviation, railways, highways and waterways shall give priority to the
transportation of personnel and related materials for control and extermination
of the epidemic situation, and post and telecommunications departments shall
deliver and transmit reports on the epidemic situation in time.
第四章動(dòng)物和動(dòng)物產(chǎn)品的檢疫
Chapter IV Quarantine of Animals and Animal Products
第三十條動(dòng)物防疫監(jiān)督機(jī)構(gòu)按照國(guó)家標(biāo)準(zhǔn)和國(guó)務(wù)院畜牧獸醫(yī)行政管理部門規(guī)定的行業(yè)標(biāo)準(zhǔn)、檢疫管理辦法和檢疫對(duì)象，依法對(duì)動(dòng)物、動(dòng)物產(chǎn)品實(shí)施檢疫。
Article 30 Supervising agencies for animal epidemic prevention shall, in
accordance with the national standards, the trade standards and quarantine
measures set by the animal husbandry and veterinary administrative department
under the State Council, and in the light of the objects to be quarantined,
carry out the quarantine of animals and animal products.
第三十一條動(dòng)物防疫監(jiān)督機(jī)構(gòu)設(shè)動(dòng)物檢疫員具體實(shí)施動(dòng)物、動(dòng)物產(chǎn)品檢疫。
Article 31 Supervising agencies for animal epidemic prevention shall have
quarantine officers responsible for the quarantine of animals and animal
products. Quarantine officers shall possess the necessary professional skills.
動(dòng)物檢疫員應(yīng)當(dāng)具有相應(yīng)的專業(yè)技術(shù)，具體資格條件和資格證書頒發(fā)辦法由國(guó)務(wù)院畜牧獸醫(yī)行政管理部門規(guī)定。
The detailed measures for qualifications and issuance of qualification
certificates shall be formulated by the animal husbandry and veterinary
administrative department under the State Council.
縣級(jí)以上畜牧獸醫(yī)行政管理部門應(yīng)當(dāng)加強(qiáng)動(dòng)物檢疫員的培訓(xùn)、考核和管理。
The animal husbandry and veterinary administrative departments at or above the
county level shall step up the training, evaluation and administration of
quarantine officers.
動(dòng)物檢疫員取得相應(yīng)的資格證書后，方可上崗實(shí)施檢疫。
No quarantine officer may be permitted to take up the post for quarantine
unless he has obtained the corresponding qualification certificate.
動(dòng)物檢疫員應(yīng)當(dāng)按照檢疫規(guī)程實(shí)施檢疫，并對(duì)檢疫結(jié)果負(fù)責(zé)。
Quarantine officers shall observe quarantine rules in carrying out quarantine
and bear liability for the quarantine results.
第三十二條國(guó)家對(duì)生豬等動(dòng)物實(shí)行定點(diǎn)屠宰、集中檢疫。
Article 32 The state exercises slaughter at designated points and centralized
quarantine of livestock like pigs and other animals.
省、自治區(qū)、直轄市人民政府規(guī)定本行政區(qū)域內(nèi)實(shí)行定點(diǎn)屠宰、集中檢疫的動(dòng)物種類和區(qū)域范圍；
The people’s governments of provinces, autonomous regions and municipalities
directly under the Central Government shall set categories of livestock and
scopes of regions within their respective administrative regions to practice
slaughter at designated points and centralized quarantine.
具體屠宰場(chǎng)（點(diǎn)）由市（包括不設(shè)區(qū)的市）、縣人民政府組織有關(guān)部門研究確定。
Specific slaughterhouses (or points) shall be determined by the people’s
governments in cities (including cities without districts) and counties after
studies by the departments concerned organized by them.
動(dòng)物防疫監(jiān)督機(jī)構(gòu)對(duì)屠宰場(chǎng)（點(diǎn)）屠宰的動(dòng)物實(shí)行檢疫并加蓋動(dòng)物防疫監(jiān)督機(jī)構(gòu)統(tǒng)一使用的驗(yàn)訖印章。
Supervising agencies for animal epidemic prevention shall carry out quarantine
of animals slaughtered in slaughterhouses (or points) and affix to slaughtered
animals their uniform stamps for having been inspected.
國(guó)務(wù)院畜牧獸醫(yī)行政管理部門、商品流通行政管理部門協(xié)商確定范圍內(nèi)的屠宰廠、肉類聯(lián)合加工廠的屠宰檢疫按照國(guó)務(wù)院的有關(guān)規(guī)定辦理，并依法進(jìn)行監(jiān)督。
Slaughter quarantine in slaughterhouses and joint meat processing factories
determined subject to consultation between the animal husbandry and veterinary
administrative department and the commodity circulation department under the
State Council shall be handled pursuant to the relevant provisions of the State
Council and shall be under supervision according to law.
第三十三條農(nóng)民個(gè)人自宰自用生豬等動(dòng)物的檢疫，由省、自治區(qū)、直轄市人民政府制定管理辦法。
Article 33 For quarantine of livestock like pigs and other animals slaughtered
by farmers themselves for their own use, the people’s governments of provinces,
autonomous regions and municipalities directly under the Central Government
shall formulate control measures.
第三十四條動(dòng)物防疫監(jiān)督機(jī)構(gòu)依法進(jìn)行檢疫，按照國(guó)務(wù)院財(cái)政、物價(jià)行政管理部門的規(guī)定收取檢疫費(fèi)用，不得加收其他費(fèi)用，也不得重復(fù)收費(fèi)。
Article 34 Supervising agencies for animal epidemic prevention shall collect
fees for their legal quarantine inspections according to the provisions of the
financial and price control departments under the State Council and shall not
collect other additional fees or repeat charging for the same item of
quarantine.
第三十五條動(dòng)物防疫監(jiān)督機(jī)構(gòu)不得從事經(jīng)營(yíng)性活動(dòng)。
Article 35 Supervising agencies for animal epidemic prevention shall not
engage in business activities.
第三十六條國(guó)內(nèi)異地引進(jìn)種用動(dòng)物及其精液、胚胎、種蛋的，應(yīng)當(dāng)先到當(dāng)?shù)貏?dòng)物防疫監(jiān)督機(jī)構(gòu)辦理檢疫審批手續(xù)并須檢疫合格。
Article 36 Those who intend to introduce breeding animals and their semen,
embryos and breeder eggs from another place in the country shall first apply to
the supervising agency for animal epidemic prevention of the locality for
examination and approval of quarantine and shall be subject to quarantine
inspection.
第三十七條人工捕獲的可能傳播動(dòng)物疫病的野生動(dòng)物，須經(jīng)捕獲地或者接收地的動(dòng)物防疫監(jiān)督機(jī)構(gòu)檢疫合格，方可出售和運(yùn)輸。
Article 37 Wild animals having been caught by man which are likely to spread
animal epidemics shall not be sold and transported before passing quarantine
inspection by the supervising agency for animal epidemic prevention in the place
where the wild animals are caught or where the wild animals are to be received.
第三十八條經(jīng)檢疫合格的動(dòng)物、動(dòng)物產(chǎn)品，由動(dòng)物防疫監(jiān)督機(jī)構(gòu)出具檢疫證明，動(dòng)物產(chǎn)品同時(shí)加蓋或者加封動(dòng)物防疫監(jiān)督機(jī)構(gòu)使用的驗(yàn)訖標(biāo)志。
Article 38 If any animal or animal product has passed quarantine inspection,
the supervising agency for animal epidemic prevention shall issue a quarantine
certificate and, at the same time for any animal product, affix thereto an
inspection mark used by the supervising agency for animal epidemic prevention or
seal it with the inspection mark.
經(jīng)檢疫不合格的動(dòng)物、動(dòng)物產(chǎn)品，由貨主在動(dòng)物檢疫員監(jiān)督下作防疫消毒和其他無(wú)害化處理；
If any animal or animal product has not passed quarantine inspection, the
owner shall conduct disinfection for epidemic prevention or take other measures
for innocent treatment.
無(wú)法作無(wú)害化處理的，予以銷毀。
If innocent treatment cannot be carried out, the animal or animal product must
be destroyed.
第三十九條動(dòng)物憑檢疫證明出售、運(yùn)輸、參加展覽、演出和比賽。
Article 39 Animals can be sold, transported, put on display, shows or contests
on the strength of the quarantine certificate.
動(dòng)物產(chǎn)品憑檢疫證明、驗(yàn)訖標(biāo)志出售和運(yùn)輸。
Animal products can be sold or transported on the strength of the quarantine
certificate and the inspection mark.
第四十條檢疫證明不得轉(zhuǎn)讓、涂改、偽造。
Article 40 The quarantine certificate shall not be transferred altered or
forged.
檢疫證明的格式和管理辦法，由國(guó)務(wù)院畜牧獸醫(yī)行政管理部門制定。
The format and control measures for the quarantine certificate shall be
formulated by the animal husbandry and veterinary administrative department
under the State Council.
第五章動(dòng)物防疫監(jiān)督
Chapter V Supervision over Animal Epidemic Prevention
第四十一條動(dòng)物防疫監(jiān)督機(jī)構(gòu)依法對(duì)動(dòng)物防疫工作進(jìn)行監(jiān)督。
Article 41 Supervising agencies for animal epidemic prevention shall conduct
supervision on the work of animal epidemic prevention according to law.
動(dòng)物防疫監(jiān)督機(jī)構(gòu)在執(zhí)行監(jiān)測(cè)、監(jiān)督任務(wù)時(shí)，可以對(duì)動(dòng)物、動(dòng)物產(chǎn)品采樣、留驗(yàn)、抽檢，對(duì)沒有檢疫證明的動(dòng)物、動(dòng)物產(chǎn)品進(jìn)行補(bǔ)檢或者重檢，對(duì)染疫或者疑似染疫的動(dòng)物和染疫的動(dòng)物產(chǎn)品進(jìn)行隔離、封存和處理。
In performing duties of monitoring and supervision, supervising agencies for
animal epidemic prevention may collect samples of animals or animal products,
seize them for inspection or make sample inspections, conduct inspections
retroactively or re-inspect animals or animal products with no quarantine
certificates, and may isolate, seal up or dispose of animals having epidemic
diseases or suspected of having epidemic diseases or animal products
contaminated by epidemic diseases.
第四十二條經(jīng)鐵路、公路、水路、航空運(yùn)輸動(dòng)物、動(dòng)物產(chǎn)品的，托運(yùn)人必須提供檢疫證明方可托運(yùn)；
Article 42 Any consignor of animals or animal products to be transported by
railways, highways, waterways or by air must provide the quarantine certificate
in consigning for shipment.
承運(yùn)人必須憑檢疫證明方可承運(yùn)。
Any consignee must undertake the shipment on the strength of the quarantine
certificate.
動(dòng)物防疫監(jiān)督機(jī)構(gòu)有權(quán)對(duì)動(dòng)物、動(dòng)物產(chǎn)品運(yùn)輸依法進(jìn)行監(jiān)督檢查。
Supervising agencies for animal epidemic prevention shall have the right to
supervise and inspect the transportation of animals and animal products
according to law.
第四十三條動(dòng)物防疫監(jiān)督工作人員執(zhí)行監(jiān)督檢查任務(wù)時(shí)，應(yīng)當(dāng)出示證件，有關(guān)單位和個(gè)人應(yīng)當(dāng)給予支持、配合。
Article 43 Functionaries of animal epidemic prevention supervision shall
produce their certificates in performing duties of supervision and inspection.
Any unit or individual concerned shall lend support and cooperation to them.
動(dòng)物防疫監(jiān)督機(jī)構(gòu)及人員進(jìn)行動(dòng)物防疫監(jiān)督檢查，不得收取費(fèi)用。
Supervising agencies for animal epidemic prevention and their staff shall not
collect fees for supervision and inspection of animal epidemic prevention.
第四十四條動(dòng)物飼養(yǎng)場(chǎng)所、貯存場(chǎng)所、屠宰廠、肉類聯(lián)合加工廠、其他定點(diǎn)屠宰場(chǎng)（點(diǎn)）和動(dòng)物產(chǎn)品冷藏場(chǎng)所的工程的選址和設(shè)計(jì)，應(yīng)當(dāng)符合國(guó)務(wù)院畜牧獸醫(yī)行政管理部門規(guī)定的動(dòng)物防疫條件。
Article 44 Selecting sites and designing for works of animal farms,
warehouses, slaughterhouses, joint meat processing factories, other designated
slaughterhouses or points and refrigeration sites for animal products shall
conform to the requirements of animal epidemic prevention stipulated by the
animal husbandry and veterinary administrative department under the State
Council.
第四十五條動(dòng)物飼養(yǎng)場(chǎng)、屠宰廠、肉類聯(lián)合加工廠和其他定點(diǎn)屠宰場(chǎng)（點(diǎn)）等單位，從事動(dòng)物飼養(yǎng)、經(jīng)營(yíng)和動(dòng)物產(chǎn)品生產(chǎn)、經(jīng)營(yíng)活動(dòng)，應(yīng)當(dāng)符合國(guó)務(wù)院畜牧獸醫(yī)行政管理部門規(guī)定的動(dòng)物防疫條件，并接受動(dòng)物防疫監(jiān)督機(jī)構(gòu)的監(jiān)督檢查。
Article 45 Raising and marketing of animals or production and marketing of
animal products by animal farms, slaughterhouses, joint meat processing
factories and other designated slaughterhouses (or points) shall conform to the
requirements for animal epidemic prevention stipulated by the animal husbandry
and veterinary administrative department under the State Council, and shall be
subject to the supervision and inspection of supervising agencies for animal
epidemic prevention.
從事動(dòng)物診療活動(dòng)，應(yīng)當(dāng)具有相應(yīng)的專業(yè)技術(shù)人員，并取得畜牧獸醫(yī)行政管理部門發(fā)放的動(dòng)物診療許可證。
Diagnosis and treatment of animals shall be engaged in by qualified
professional technicians who possess the permit for diagnosis and treatment of
animals issued by the animal husbandry and veterinary administrative
departments.
患有人畜共患傳染病的人員不得直接從事動(dòng)物診療以及動(dòng)物飼養(yǎng)、經(jīng)營(yíng)和動(dòng)物產(chǎn)品生產(chǎn)、經(jīng)營(yíng)活動(dòng)。
Persons suffering from epidemic diseases contracted commonly by both human
beings and livestock shall not directly engage in diagnosis and treatment of
animals, raising and marketing of animals or production and marketing of animal
products.
第六章法律責(zé)任
Chapter VI Legal Liability
第四十六條違反本法規(guī)定，有下列行為之一的，由動(dòng)物防疫監(jiān)督機(jī)構(gòu)給予警告；拒不改正的，由動(dòng)物防疫監(jiān)督機(jī)構(gòu)依法代作處理，處理所需費(fèi)用由違法行為人承擔(dān)：
Article 46 Any violator of the provisions of this Law who commits any of the
following acts shall be given a warning by the supervising agency for animal
epidemic prevention. In case of refusal by the violator to make corrections, the
supervising agency for animal epidemic prevention shall deal with the case
according to law on the part of the violator who shall pay the expense therefor.
?。ㄒ唬?duì)飼養(yǎng)、經(jīng)營(yíng)的動(dòng)物不按照動(dòng)物疫病的強(qiáng)制免疫計(jì)劃和國(guó)家有關(guān)規(guī)定及時(shí)進(jìn)行免疫接種和消毒的；
(1) Failing to vaccinate or disinfect for immunization timely animals he
raises or markets as required by the compulsory immunization plan against animal
epidemics and the relevant state provisions;
?。ǘ?duì)動(dòng)物、動(dòng)物產(chǎn)品的運(yùn)載工具、墊料、包裝物不按照國(guó)家有關(guān)規(guī)定清洗消毒的；
(2) Failing to clean and disinfect means of transport, padding materials or
packing materials for animals and animal products according to the relevant
state provisions; or
?。ㄈ┎话凑諊?guó)家有關(guān)規(guī)定處置染疫動(dòng)物及其排泄物、染疫動(dòng)物的產(chǎn)品、病死或者死因不明的動(dòng)物尸體的。
(3) Failing to dispose of animals infected with epidemic diseases and their
excrement, products made from animals infected with epidemic diseases, and
carcasses of animals which died of illness or died due to an unidentified cause
according to the relevant state provisions.
第四十七條違反本法第十七條規(guī)定，保存、使用、運(yùn)輸動(dòng)物源性致病微生物或者運(yùn)輸動(dòng)物病料的，由動(dòng)物防疫監(jiān)督機(jī)構(gòu)給予警告，可以并處二千元以下的罰款。
Article 47 Any violator of the provisions of Article 17 of this Law who
stores, uses or transports animal-borne pathogenic microorganisms, or transports
animal epidemic materials shall be given a warning and may be concurrently fined
not more than RMB 2,000 yuan by the supervising agency for animal epidemic
prevention.
第四十八條違反本法規(guī)定，經(jīng)營(yíng)下列動(dòng)物、動(dòng)物產(chǎn)品的，由動(dòng)物防疫監(jiān)督機(jī)構(gòu)責(zé)令停止經(jīng)營(yíng)，立即采取有效措施收回已售出的動(dòng)物、動(dòng)物產(chǎn)品，沒收違法所得和未售出的動(dòng)物、動(dòng)物產(chǎn)品；
Article 48 Any violator of the provisions of this Law who markets any of the
following animals or animal products shall be ordered by the supervising agency
for animal epidemic prevention to stop the business operations and, with the
illegal gains and animals and animal products having not yet been sold
confiscated, to take effective measures to withdraw animals and animal products
having been sold.
情節(jié)嚴(yán)重的，可以并處違法所得五倍以下的罰款：
If the circumstances are serious, the offender may be concurrently fined less
than five times of the illegal gains.
?。ㄒ唬┓怄i疫區(qū)內(nèi)與所發(fā)生動(dòng)物疫病有關(guān)的；
(1) Those related to an animal epidemic occurring in a cordoned-off epidemic
area;
?。ǘ┮邊^(qū)內(nèi)易感染的；
(2) Those susceptible to an epidemic in an epidemic area;
?。ㄈ┮婪☉?yīng)當(dāng)檢疫而檢疫不合格的；
(3) Those subjected to quarantine inspection according to law but failing to
pass quarantine inspection;
?。ㄋ模┤疽叩?；
(4) Those infected with an epidemic;
（五）病死或者死因不明的；
(5) Those which died of illness or died due to an unidentified cause; or
?。┢渌环蠂?guó)家有關(guān)動(dòng)物防疫規(guī)定的。
(6) Those not listed above but failing to conform to the state provisions
regarding animal epidemic prevention.
第四十九條違反本法規(guī)定，經(jīng)營(yíng)依法應(yīng)當(dāng)檢疫而沒有檢疫證明的動(dòng)物、動(dòng)物產(chǎn)品的，由動(dòng)物防疫監(jiān)督機(jī)構(gòu)責(zé)令停止經(jīng)營(yíng)，沒收違法所得；
Article 49 Any violator of the provisions of this Law who markets animals or
animal products subjected to quarantine inspection according to law but without
quarantine certificates shall be ordered, with the illegal gains confiscated, to
stop the business operations by the supervising agency for animal epidemic
prevention.
對(duì)未售出的動(dòng)物、動(dòng)物產(chǎn)品，依法補(bǔ)檢，并依照本法第三十八條的規(guī)定辦理。
Animals or animal products having not yet been sold shall undergo quarantine
inspection retrospectively according to law and be dealt with according to the
provisions of Article 38 of this Law.
第五十條違反本法第四十二條規(guī)定，不執(zhí)行憑檢疫證明運(yùn)輸動(dòng)物、動(dòng)物產(chǎn)品的規(guī)定的，由動(dòng)物防疫監(jiān)督機(jī)構(gòu)給予警告，責(zé)令改正；情節(jié)嚴(yán)重的，可以對(duì)托運(yùn)人和承運(yùn)人分別處以運(yùn)輸費(fèi)用三倍以下的罰款。
Article 50 Any violator of the provisions of Article 42 of this Law who fails
to implement the provisions for the shipment of animals or animal products on
the strength of the quarantine certificate shall be given a warning and ordered
to make corrections by the supervising agency for animal epidemic prevention. If
the circumstances are serious, the consignor and the consignee may be separately
fined less than three times of the freight.
第五十一條轉(zhuǎn)讓、涂改、偽造檢疫證明的，由動(dòng)物防疫監(jiān)督機(jī)構(gòu)沒收違法所得，收繳檢疫證明；轉(zhuǎn)讓、涂改檢疫證明的，并處二千元以上五千元以下的罰款，違法所得超過(guò)五千元的，并處違法所得一倍以上三倍以下的罰款；
Article 51 If anyone transfers, alters or forges the quarantine certificate,
the supervising agency for animal epidemic prevention shall confiscate the
illegal gains and withdraw the quarantine certificate. Anyone who transfers or
alters the quarantine certificate shall be concurrently fined not less than RMB
2,000 yuan and not more than RMB 5,000 yuan; if the illegal gains exceed RMB
5,000 yuan, the offender shall be concurrently fined not less than the amount of
the illegal gains and not more than three times of that amount.
偽造檢疫證明的，并處一萬(wàn)元以上三萬(wàn)元以下的罰款，違法所得超過(guò)三萬(wàn)元的，并處違法所得一倍以上三倍以下的罰款；構(gòu)成犯罪的，依法追究刑事責(zé)任。
Anyone who forges the quarantine certificate shall be fined not less than RMB
10,000 yuan and not more than RMB 30,000 yuan; if the illegal gains exceed RMB
30,000 yuan, the offender shall be concurrently fined not less than the amount
of the illegal gains and not more than three times of that amount. If a crime
has been constituted, the offender shall be investigated for criminal
responsibility according to law.
第五十二條違反本法第四十五條第一款規(guī)定，從事動(dòng)物飼養(yǎng)、經(jīng)營(yíng)和動(dòng)物產(chǎn)品生產(chǎn)、經(jīng)營(yíng)活動(dòng)的單位的動(dòng)物防疫條件不符合規(guī)定的，由動(dòng)物防疫監(jiān)督機(jī)構(gòu)給予警告、責(zé)令改正；
Article 52 If a unit engaging in raising or marketing of animals, or
production or marketing of animal products, in violation of the provisions of
the first paragraph of Article 45 of this Law, fails to conform to the
requirements for animal epidemic prevention, the supervising agency for animal
epidemic prevention shall give a warning and order it to make corrections.
拒不改正的，并處一萬(wàn)元以上三萬(wàn)元以下的罰款。
If it refuses to make corrections, the offender shall be fined not less than
RMB 10,000 yuan and not more than RMB 30,000 yuan.
第五十三條違反本法規(guī)定，單位瞞報(bào)、謊報(bào)或者阻礙他人報(bào)告動(dòng)物疫情的，由動(dòng)物防疫監(jiān)督機(jī)構(gòu)給予警告，并處二千元以上五千元以下的罰款；
Article 53 If a unit, in violation of the provisions of this Law, conceals,
falsely reports or hinders another person to report animal epidemic information,
the supervising agency for animal epidemic prevention shall give a warning and
concurrently impose a fine not less than RMB 2,000 yuan and not more than RMB
5,000 yuan.
對(duì)負(fù)有直接責(zé)任的主管人員和其他直接責(zé)任人員，依法給予行政處分。
The person in charge directly responsible and other persons directly
responsible shall be imposed administrative sanctions according to law.
第五十四條違反本法規(guī)定，逃避檢疫，引起重大動(dòng)物疫情，致使養(yǎng)殖業(yè)生產(chǎn)遭受重大損失或者嚴(yán)重危害人體健康的，依法追究刑事責(zé)任。
Article 54 Any violator of the provisions of this Law who evades quarantine
inspection, resulting in a serious animal epidemic which causes great losses to
the breeding production or does serious harm to human health, shall be
investigated for criminal responsibility according to law.
第五十五條動(dòng)物檢疫員違反本法規(guī)定，對(duì)未經(jīng)檢疫或者檢疫不合格的動(dòng)物、動(dòng)物產(chǎn)品出具檢疫證明、加蓋驗(yàn)訖印章的，由其所在單位或者上級(jí)主管機(jī)關(guān)給予記過(guò)或者撤銷動(dòng)物檢疫員資格的處分；情節(jié)嚴(yán)重的，給予開除的處分。
Article 55 If any animal quarantine officer, in violation of the provisions of
this Law, issues the quarantine certificate and affixes the inspection mark on
animals or animal products having not undergone quarantine inspection or having
not passed quarantine inspection, the unit to which he belongs or the competent
authority at the next higher level shall give him a demerit or disqualify him as
an animal quarantine officer. If the circumstances are serious, the offender
shall be discharged from his office.
因前款規(guī)定的違法行為給有關(guān)當(dāng)事人造成損害的，由動(dòng)物檢疫員所在單位承擔(dān)賠償責(zé)任。
If the illegal act mentioned in the preceding paragraph causes damage to the
interested party, the unit to which the animal quarantine officer belongs shall
bear the liability for compensation.
第五十六條動(dòng)物防疫監(jiān)督工作人員濫用職權(quán)，玩忽職守，徇私舞弊，隱瞞和延誤疫情報(bào)告，偽造檢疫結(jié)果，構(gòu)成犯罪的，依法追究刑事責(zé)任；尚不構(gòu)成犯罪的，依法給予行政處分。
Article 56 Any supervisor of animal epidemic prevention who abuses powers,
neglects duties, commits malpractices for selfish gains, conceals or delays the
report on epidemic situations, or forges quarantine inspection results, if a
crime has been constituted, shall be investigated for criminal responsibility
according to law. If a crime has not been constituted, the offender shall be
imposed administrative sanctions.
第五十七條阻礙動(dòng)物防疫監(jiān)督工作人員依法執(zhí)行職務(wù)，構(gòu)成犯罪的，依法追究刑事責(zé)任；尚不構(gòu)成犯罪的，依法給予治安管理處罰。
Article 57 Whoever hinders a supervisor of animal epidemic prevention in the
performance of duties according to law shall, if a crime has been constituted,
be investigated for criminal responsibility according to law. If a crime has not
been constituted, the offender shall be imposed administrative penalty for
public security violations according to law.
第七章附則
Chapter VII Supplementary Provisions
第五十八條本法自１９９８年１月１日起施行。
Article 58 This Law comes into effect as of January 1, 1998.
